Third party insurer put MIAFTR marker against car....nightmare!

Hi all

I am trying to help one of my sons who is having a nightmare with this company.

He has comprehensive motor insurance and two months ago a lady drove into the side of his car. No one hurt, lady gave her details, son contacted MM and started a claim. Seemingly the most banale and ordinary no fault claim The damage to the car was sufficient apparently that the car was written off and MM's agents subsequently collected it.

Roll on 2 months and MM in response to being chased about the claim state:

  1. They cannot get hold of the lady's insurance company (a top 10 UK insurer)?!?!
  2. There is MIAFTR market against my son's car apparently put on by the 3rd party insurer.
  3. My son needs to contact the 3rd party insurer as apparently only he can get it removed.

Despite my best efforts there does not seem any way to contact the 3rd party insurer as of course my son is not a customer of theirs and it is unclear whether they would remove the marker anyway on the basis of such a "random" call.

From going through the email correspondence, this all seems to be one long attempt my MM to kick the claim onto the long grass hoping that their mostly young clientele will give up.

Any advice on how to break this impasse would be much appreciated.

    Appoligies - his insurer is Marshmallow. They say that they cannot proceed with processing his claim until the marker put on by Direct Dial is removed. Presumably they will then put their own marker on the system as the car is indeed a write-off

    I doubt this is a deliberate ploy by marshmallow to 'kick it into the long grass' but I don't see why the tp insurers marker makes a difference unless marshmallow suspect 2 claims.

    You can talk to the tp insurers - quite normal in a claim. Who are the tp insurers?

    When everyone wants the cheapest insurance they can find, rather than the insurer with the best customer service reputation, the reality is claims teams dont have people hanging around awaiting the next call or letter to deal with. They have backlogs, work is prioritised and third party insurers are often right at the very bottom of the priority list unless it's a LBA and those more commonly come from solicitors rather than the TPI.

    Some of the largest insurers, particularly those that have grown via acquisitions, have the most complex and unjoined up systems. Some are just simply a pain in the !!!!; NIG (formerly part of the DLG) used to have two offices on the opposite sides of the road, one did motor targeted at farms (but normal cars in addition to tractors etc) and the other was just general commercial motor insurance. If you sent a letter to the wrong office, would they walk it across the road? Nope, they would send it back saying they dont recognise the registration plate.

    A) What type of marker is on it?

    B) What date was the marker loaded?

    It would be very odd for the TPI to randomly add a MIATR marker to a vehicle they arent dealing with.

    C) How long has he owned the vehicle? Bought from new or secondhand?

    It would be much more probable to me that the vehicle was previously a write off, and so has a MIATR marker from that, and it could be coincidentally the same insurer if they are a "top ten" insurer.
