UK Car Park Management - SIPPI app did not take payment

I parked in a CPM car park and had to download the app, Sippi to pay for my parking. The app downloaded on my phone and I entered my credit card details. I faithfully thought I'd paid for parking and have a screen shot to show that my card was registered. I tapped 'pay' and went about my day.

However, I received a fine for £100, reduced to £60 if I paid within the time limit.

I appealed, stating the facts above with evidence. My intention was to pay and I thought I had. The screen shot only says 'card registration' and my banking app is showing £0.0.

My appeal has not been upheld.

I have tried to appeal with the IAS but the PCN is not registered with them.

What should I do?

Thanks

Just ignore, like the NEWBIES thread tells you at post 4.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Been a few of these Sippi App cases recently, makes one wonder how bad these apps are ?

You most definitely did not receive a fine

Thanks for your help on this.

Here is the reply from CPM to my case that I lodged with the IAS. I faithfully thought I'd paid and provided evidence to show that the app had downloaded on my mobile and that my credit card was stored in the app. I even sent a screenshot to show that the app logged a payment but had not taken any money - which I thought it had done. The instructions about swiping left and right to stop and start parking sessions are new to me.

I think they are missing the point that I thought I had paid via their convoluted parking app system. Surely this is not right?

The appellant has been captured by ANPR entering and exiting the car park. The vehicle remained within the car park for a total duration of 2 hours 19 minutes. This can be seen in the attached document xxxxxxx

The appellant has parked within the car park and did not make payment for the full duration of their stay.

Signage clearly states, "VEHICLES MUST PAY THE TARIFF TO COVER THE FULL DURATION OF YOUR STAY, ENTERING THE FULL AND CORRECT VEHICLE REGISTRATION NUMBER AT THE PAYMENT TERMINAL OR VIA THE CASHLESS PAYMENT FACILITIES".

We have searched our records and cannot locate any evidence of a payment made under vehicle registration xxxxxx on the date of contravention, however other vehicles have registered on the E-permit system. Evidence of this can be seen in the attached document 'xxxxxxx'.

The terms and conditions displayed on the signage at the site clearly require motorists to ensure that valid payment has been successfully made for the duration of their stay. It is the responsibility of the motorist to confirm that payment has been completed before leaving the vehicle. The Sippi app requires motorists to swipe right to commence a parking session and swipe right again once ready to depart, to end the session.

Whilst the Appellant states that they downloaded the payment application, created an account and entered their payment details, no evidence has been provided to demonstrate that a valid parking session was successfully purchased or started. Had payment been completed, the Appellant would ordinarily have received confirmation within the application and/or by email, depending on the app's settings.

UK CPM has no record of a valid payment being made for the vehicle on the date in question. The fact that the Appellant subsequently discovered that no payment had been taken confirms that the parking session was not successfully purchased.

The Appellant attributes this to a failure of the payment application; however, no evidence has been provided to demonstrate that the payment service experienced a technical fault at the material time. In the absence of such evidence, UK CPM cannot conclude that there was any failure of the payment system. Furthermore, we have enclosed evidence from our back-office system which shows that other motorists were able to make payment for their full correct vehicle registrations on this date, including whilst the Appellant's vehicle was parked on site. Therefore, proving there was no issue with the payment machines or cashless payment app.

Even if the Appellant experienced difficulty using the payment application, it remains the responsibility of the motorist to ensure that payment has been successfully completed before leaving the vehicle. Where payment is not confirmed, motorists are expected to retry the transaction or use any alternative payment method provided at the site.

UK CPM does not suggest that the Appellant deliberately sought to avoid payment. However, the Parking Charge Notice was issued because no valid parking session was in place in accordance with the clearly displayed contractual terms and conditions. The reason why payment was not completed does not alter the fact that the parking contract was breached.

It is the driver's responsibility to ensure they enter their full, correct vehicle registration when making payment for parking as this is the only way UK CPM can determine which vehicles are authorised to park.

By the appellant parking at the restricted area, they have contractually agreed to pay the parking charge notice.

Just ignore it when you 'lose' at IAS. It really doesn't matter a jot as you'll never pay.
