Smart Parking NTK
Hi all,
I would be grateful for some advice regarding a Smart Parking PCN.
Timeline:
- Parking event: 24/05/2026
- Notice to Keeper issued: 04/06/2026
- Registered keeper appealed using the standard NEWBIES template as keeper only (no driver identified).
- Smart Parking rejected the appeal on 30/06/2026 and have directed us to the IAS.
The allegation is "paid for insufficient time". No payment was made.
The registered keeper was not the driver and the driver's identity has not been disclosed to Smart Parking.
One point that concerns me is POFA compliance. The Notice to Keeper is dated 04/06/2026 for a parking event on 24/05/2026. The MSE POFA deadline checker indicates that the Notice would be deemed served on 08/06/2026 (15 days after the event), suggesting it was not "given" within the period required by Schedule 4 of the Protection of Freedoms Act 2012.
In their rejection letter, Smart Parking state:
"The parking contravention occurred on 24.05.2026, and this notice was issued on 04.06.2026, within the 14-day period required."
They appear to rely on the issue date rather than the deemed date of service.
Would the regulars recommend taking this point to the IAS, or is there a different strategy you would suggest?
Many thanks.

You can either ignore it and let it go to a DCB Legal claim, which they'll discontinue, or try IAS for the LOLs!
Either way you'll never pay.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you. Would you recommend using the IAS appeal to argue that the Notice to Keeper was not 'given' within the Schedule 4 timeframe (issued 04/06/2026 for an event on 24/05/2026), or would you simply ignore the IAS and wait?

There is no real recommendation, just 2 schools of thought
- Have a look at the cooldude posts recently, with a possible basis of an IAS appeal , OR
- ignore them and fight any future court claim

I tell my relatives to ignore the IAS
