A bit of advice please on my Dad's parking ticket
Hi all,
My Dad (in his 80's) got a private parking ticket for overstaying the free period of 10 minutes by less than a minute. My parents received this fine from Napier Parking. They've already "appealed" the fine on napierparking.co.uk site, which is what the initial PCN they got through the post directed them to do if they wanted to appeal.
They've now received a second letter telling them their appeal has been rejected. That letter is below.
I'm now trying to help them. The template information on here talks about using MCOL. This is to defend the Small Claims process right?
So do they just sit tight now and do nothing? Wait for the parking company to take this through the small claims process (if they do) and then defend via MCOL?
Thanks
Jon

Definitely don’t pay it.
An appeal to IAS isn’t worth it as they are independent.
You, or more accurately your Dad, need to just wait for the LBC to which you’ll respond. Tell them if there is a change of address. Ignore the joke £170 threatograms4 -
They seem to be saying he didn't pay at all?
Does he have a Blue Badge?
Does he have any medical conditions that slow him down or affect stamina? Arthritis?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

There is no "fine" it is an invoice for damages, there is no "free period" either I suppose you mean the consideration period which they will say is 5 minutes in a car park with under 500 spaces.
But of course this is unfair they are just greedy scammers it would take them 10 minutes to find any terms and conditions to decide if they wanted to stay:

Thanks everyone for the replies.
My Dad was driving, didn't even get out the car, and left the engine running. My Mum went to read the signage. She says it said 10 minutes free/grace period (or "consideration" period seems to be the right language as above). It also appears you can only pay by phone or app.
Unfortunately I don't have a picture of the sign to double check the above, and I can't find one on the internet. The company did send my parents one but it's blurry! I'll attach it below.
They're not blue badge holders, but they have ailments, are slow and not great with technology. They stayed just under 11 minutes.
I've told them to do nothing else now. Sounds like at some stage they'll get a Letter Before Claim. I'm then assuming at that stage it'll move onto the MCOL portal, and I can help them as per the template?
Thanks
Jon

👆👆correct. It’s at the court stage that this can be sorted - unlikely they will go as far as a hearing. The IAS is 95% weighted towards its bedfellows - the IPC network of private parking operators. No chance of any favourable outcome. Stay with us.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Napier don't tend to make a lot of claims, BW Legal will likely send some threatograms followed by a Letter of Claim.
Hold firm and don't pay the scam.Always remember to abide by Space Corps Directive 39436175880932/B:
'All nations attending the conference are only allocated one parking space.'

Thanks. I've tried that, but I personally can't find a clear picture of the up to date signage showing their T&C's.

Well if that photo they sent you is the best they can do they won't get very far with their claim what a bunch of chancers.
As they are well remote from this area I doubt they will have an attendant near to photograph the signage on site, they want to use ANPR they are the consequences for them.
Taking up @GrannyKate comment I could only find one decent photo which was from the time Smart ran it, most of the others are of different places or too far away to read.
Seeing the OP's outline of the event and considering his parents' predicament etc., using pay by app is an unfair term they couldn't comply with and left at their earliest opportunity, they actually derived no service or benefit from the landowner to expect a consideration for.

A mouldy Soviet potato has better image resolution than the sign photo Napier sent…
Edit: OP, definitely don't do an IAS appeal as they're little better than the Star Chamber was, so you want that Letter of Claim because they can be seen off there.
