NCP BIRMINGHAM AIRPORT FINE
Hi everyone. I need help with this.
First of all I am not in a financial position to even do this.
I picked up my sister from the airport. This is the first time I am going there. I ended up at the BIRMINGHAM AIRPORT PREMIUM SET DOWN ZONE where I was trying to figure out where I should go. I did not know I had to pay. I tought being a drop off you have the "10 minute" grace period.
I have just received a fine of £100 and I don’t know how to go about it. I was there for just 3 minutes

Birmingham Airport is one of the worst examples of a setup where it's impossible to read the terms of the alleged 'contract' and then decide not to agree to those terms. The premium set down terms are displayed at the point you filter into the car park, and there's no way to get back out apart from going through the ANPR gate and incurring the fee or a penalty charge.

What dates are showing on your NtK please? NCP are in administration. Q to any regulars who might know, does KADOE access continue despite administration status?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

IS THIS ANY GOOD?
I appeal as the registered keeper. I am under no legal obligation to identify the driver, and I decline to do so.
1.You are unable to transfer liability to the keeper under Schedule 4 of the Protection of Freedoms Act 2012 ("POFA") because airport drop-off zones are not "relevant land" as defined by POFA.
2.Even if (which is denied) the land were relevant land, your Notice to Keeper does not comply with the mandatory requirements of Schedule 4, paragraphs 9(2)(e) and 9(2)(f) of POFA.
Furthermore, as keeper, I am entitled to rely on all defences available to the driver, including (without limitation):
3.The parking charge was not adequately brought to the driver's attention before any alleged contract was formed and, applying the principles in Thornton v Shoe Lane Parking Ltd, it did not form part of any contract.
4.The signage does not comply with the BPA Code of Practice.
5.The vehicle was present in the drop-off zone for no more than three minutes, which is well within the minimum five-minute consideration period required by the BPA Code of Practice.
Any one of the above grounds is sufficient to require cancellation of this Parking Charge Notice.
In light of the above, you must cancel this Parking Charge Notice. If you reject this appeal, please provide a Notice of Rejection together with a POPLA verification code so that I may refer the matter to independent adjudication.
