A thread was made a while ago to appeal consecutive parking charges - two were won as they were both NON-POFA (thank you to the thread!!) and now the others are being dealt with.

Two POPLA codes were received and waiting on a final, but all three appeals were done consecutively and yet to receive the final one? The timestamps was written on the appeal of the papers when submitted. I hope their mistake doesn't mess up my chance of appealing via POPLA

Is it an error on their side or my end? However, without a doubt, I know I appealed all charges.

Unfortunately, horizon does not provide references once an appeal has been made so it is not at all helpful.

What could I do?

as a thought is it worth to appeal again via horizon stating this has already been appealed or would that just be a waste of time?

Nope. Raise a complaint.

But why are you even trying POPLA with Horizon POFA notices? I wouldn't usually bother. What's your winning point?

What happened re a complaint to the landowner?

And without any criticism: how did you/the driver get several? It is easy enough to be careful where you park, use the street, avoid private car parks and NOT to get private PCNs and - if you get overwhelmed by them - it's quite a credit risk to rack them up.

There is inadequate signage at the location. It was not sporadic event, unfortunately it all occurred exactly one day after another. Since notifying the driver of the letters, the driver hasn't returned there

It is an outdoor park and information was requested from Horizon, but not provided

Is it the new regime at Ashdown Forest or a national trust site?

I'm asking because they are newish changes which - under the CoP - require additional 'new restriction' warning entrance signs, in addition to the usual 'P' entrance sign.

The extra signs or banners at the entrance have to be there for at least 4 months to alert people to changes.

That can win at POPLA if you go and get photos of a LACK of an additional warning sign - specifically at the entrance - and argue at POPLA stage that this is a 'new restriction'.

Even if you don't know if it is new or when things changed, say that you 'believe this is new/changed restrictions this Spring' and cite it as a Code breach (quote the clause about new restrictions).

That makes Horizon have to disprove it.

Just seeing this now, it was not at Ashdown Forest, it was at Centre Road Car Park.

There have been other motorist who have dealt with the same issue, in which they've even left a review on google lol. Currently waiting to hear back from POPLA, they want me to provide comments to oppose the operator - which I think the best bet would be to not comment and just let me original appeal do the speaking.

What are your thoughts?

We disagree.

You'll likely lose at POPLA anyway, as it isn't independent and mostly their fee paying parking operators are believed, but POPLA Comments stage is already explained in post 3 of the NEWBIES thread. Of course you make concise comments. Say what you see.

You won't be paying if you 'lose' and shouldn't really have wasted time on POPLA.

Did you also admit to driving…?

Did you raise the issue that it's a new regime and there were no extra warning signs up at the entrance?

Hey, there was no admittance to driving by the motorist. The issue regarding a lack of signage was raised.

In summary:
Three of the letters were cancelled, and the other two failed at POPLA stage.

My POPLA appeal was rejected on 25th August, and a NTK reminder letter was issued on the 25th. How is it possible that the letter would have reached me on the exact date.

Furthermore, Horizon sent a NTK reminder notification regarding paying £100 within the 28 days. However, it is unusual because there is no date on the letter stating when it was sent so there is no way to make out the exact timeline of the 28 days if that makes sense.

Surely that isn't right?

For a company to request such an amount, they should at the very least include the date a letter was sent to give the motorist a timeline.
