claim form from UK Parking Patrol Office

Hi,

I'm helping a neighbour with a private PCN that has advanced to a N1SDT claim form. He had ignored all letters received and discarded them. He does not even recall being parked in the place in question as he is away on work very frequently and his car is in use by other family members.

The claim form issue date is 18th of May and I helped him file an acknowledgement of service on 3rd of June. We need to file the defence by 22nd of June but not sure what his best defence would be as he does not have any of the original paperwork. Also this company rarely takes things to court from what I have gathered.

So its UKPPO via B W Legal, for parked causing obstruction ( not in-house. )

Personally, I would expect it to go all the way through the process

The defendant should use a version of the template defence in announcements

Yep just use the Template Defence, top of the forum. No link needed as you already have two on this page (see my signature).

Never seen an "obstruction" go all the way through to a hearing. What was obstructed? Who's to say? What damage was caused? etc. etc. A high bar for them when it's opinion based.

UKPPO PCNs don't conform to POFA so add that it could be any driver and liability cannot be transferred to the keeper. See the stickied thread.

If its believed that the pcn was non Pofa2012, I suggest that you use the Smart Parking template defence by member meltof

B W Legal dont have a history of discontinuing, but its better to plan for the worst because these companies are testing the water more, with some test cases

With an issue date of 18/05/26 and having completed the AoS in a timely manner your defence deadline date is 4.00 p.m. on 22/06/26

Here's how to find that, if you are sure the NTK was non-POFA and the Defendant didn't blab about being the driver in an appeal:

Just click on the username @Meltof

Copy their version of a final defence posted on April 12th. Obviously, if UKPPO didn't use or comply with the POFA, there's no 'keeper liability' possible.
