"I guess that the 'elephant in the room' question is; was the vehicle charging during that time?"

Except that wasn't pleaded in the POC!

    Not sure that's true.

POC specifies "vehicle parked in a charging bay" - they may claim that an electric vehicle is 'parked' in the bay if it is not charging.

I'm just playing devils advocate here purely to point out that the defence of 'my car is an electric vehicle' does not defend the claim purely because the it's an electric vehicle. 'Parking' and 'Charging' may well be considered different activities?

At what point does ‘charging’ become ‘parking’. Most motorists while charging their cars go for a coffee/meal break, during which time the charge might complete (and the indicator light on the charge pump changes colour) meaning the car no longer under charge. Does it then immediately become ‘parked’?

That indicator light could be a parking gimp’s dream!

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Agree 100% and that is exactly went on in a so called 'Park & Ride' car park in my local town.

The car park is next to the railway station and encourages people to park there in order to take the 20 minute train ride to the city centre.

The car park has many EV bays - loads and loads.

But the operator started dishing out tickets to vehicles which remained in charging bays after charging was completed.

This defeats the object of the car park since people who were charging while they were at work started getting PCNs. Most people who go into the office obviously do so for around 8 or 9 hours meaning that charging generally finished before they returned to collect their vehicles.

I could not really find much information online. I found this https://www.ev-point.com/locations/heathrow/ it does not really have any terms and conditions or any information about how long the parking is there for. Other than an icon saying "Free parking."

The driver was charging the car throughout the time they were at the location.

Errrm… you realise that's your silver bullet?!

The EV charging firm leases that bay so they have title in that parcel of land. They advertise and make a clear offer 'free parking' without caveat, for those EV owners who use their bays to charge. The parking firm have no remit over leased EV bays.
