Who's the creditor?

Hi all,

I'm having great joy with Total Car Parks who name themselves as creditor on the Notice to Keeper.

However it's not that simple. TCP are subcontracted for the site by County Car Parks who in turn are contractually bound to the landowner- So the big question is.. Who's the creditor?

Thanks everyone.

    TCP are the creditor.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Although that doesn't mean their contract is necessarily valid.

  • Well they do seem to be a little dim.

Proof of land owner authority referencing the old land owner (I have a copy of the title deeds of the new owner)

County Car Parks stating they are the land owner in the letter of authority

    It's tragic..

  • Hi @Coupon-mad

    Do you mean my

"Proof of land owner authority referencing the old land owner (I have a copy of the title deeds of the new owner)"

Agreement between County Car Parks and Total Car Parks May 2025

Agreement between County Car Parks and previous landowner 2020. Note: owner had specified that subcontracting had to be agreed in writing - No evidence in popla pack.

The new landowner took over Jan 2021 ,of whom no reference is made in popla evidence pack except to say that land was sold.

    Date of "incident" March 2026.

    Interesting.

TCP had no authority flowing to them, based on that evidence.

  • That's based on the old landowner, as Total or County haven't produced any evidence of a contract with the new landowner it doesn't look great for them does it?

No it doesn't look good for them!

No evidence to the contrary nor even that the new landowner authorised them and what that document says as regards terms, exemptions, hours of operation, etc.

  • Thank you very much @Coupon-mad

Something is amiss in TCP land….My mission is to uncover it.

If I were to submit a freedom of information request to the DVLA to dig a little deeper would I need to request evidence of a contract between the landowner and both Total Car Parks (TCP) and County Car Parks (CCP) individually ,or from the landowner to CCP (as the subcontractor) through to TCP ?

Many thanks to you and the forum for all your fantastic help.

No that doesn't work. The DVLA don't hold that.
