Buyer protection expiring after original delivery estimate

Hello everyone,

I ordered something from ebay but it was out of stock, wasn't desperate for it so waited. It was marked as despatched a month after the original order, but still hasn't arrived.

I contacted ebay and they say the buyer protection expires 30 days after the original delivery estimate, not when it's actually sent, even if it is out of stock.

Is there anything I can do about it? Is it even legal?

Buyer protection is an ebay policy, they can do whatever they want.

It doesn't change your legal rights though. We're you buying new or second hand, and from a business or an individual?

II'm also currently suffering from this.

Purchased an (expensive) item from the USA.

Was dispatched with ebay International postage.

Delivery estimate was (ebays usual unrealistic) 5-8 days

I could see from the tracking that the seller dispatched the item quickly and it made fairly quick progress across the usa then everything slowed right up at the International part.

After it finally got to the uk it sat in the royal mail superhub with no further movement.

When I went to open a INR I'm just told I can't as its more than 30 days past the estimate date.

So I've lost money on both the item and the expensive postage and import fees.

In theory I am at least entitled to have the import duty refunded but ebay are just replying from the same script to messages about that as well!

Lesson learned hopefully - You should always report sn item as not received once the estimated delivery date is passed. That at least starts the process and pauses the ebay deadline. You can always close the report if the item later arrives

Have you contacted the seller? How much was the item and how did you pay?

If the item was out of stock.and then 'came into stock' I'm presuming this is a business seller....

Tbh even if they are happy to refund you they may not be able to on ebay, but they can certainly send out another item.

If you paid via a card then use Chargeback for goods not received.

It was a new item, the seller is registered as private and buyer protection was add to the cost. I've contacted the seller but they aren't responding. Luckily this order didn't cost much but I do spend a lot through ebay, and things have been delayed or not arrived before, but this is the first time I've had this happen. I'll try that chargeback on my card.
