Travelodge - Horizon Parking (Parked out of a marked Bay)
Hi, I think I have entered my era of collecting parking tickets. I was doing good for so long lol.
Anyway long story short I was staying at Travelodge, ended up parking outside of a marked bay as no spaces were available. I am a blue badge holder and annoyingly 4 cars in the disabled bays didn't even have a disabled badge displayed.
I parked where I could like many other cars did which is no excuse (it was on a double red which i'm not sure stands on private land) however ticket issued is for ' Parked out of a marked bay'.
I have tried to raise the blue badge issue with Travelodge to see if they can check their records, if they do decline do you think I'm alright to ignore Horizon or is a bit of a 50/50.
Thank you in advance and sorry for the life story lol

The intention is some sort of no parking area. But you'll notice the sign has an illustration of a car parked at an angle, over the lines.
I don't see how you have agreed to pay a sum for parking on red lines when there is no such clause in the contract. Outside a marked bay is defined by their illustration.
The CRA 2015 states that any contract term ambiguity shall fall in favour of the consumer.
You could try Popla, but obviously it's a lottery. But you don't pay even if you lose.
Court is possible, but I wouldn't mind arguing your points personally. Their contract is faulty - they could have made it clear, but have failed to do so. I think they would have had more chance with the obstructive parking clause!
Try kicking off with Travelodge, but they are notoriously unhelpful.

I'd appeal to Horizon as keeper, not saying who was driving. Should be winnable at POPLA.
Show us both sides of the NTK and a pic of the nearest sign to those red lines.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hey @Coupon-mad
Hope these pictures are okay, what do you think?0 -

The NtK does not comply with PoFA Schedule 4 Paragraph 9(2)(b).
9(2)(b) specifies;
The notice MUST inform the keeper that the driver is required to pay parking charges in respect of the specified period of parking and that the parking charges have not been paid in full.
The required information is not present on the NtK.

That's a good spot and worth a punt.

hey @yarpsnehpets
So I've complained to Travelodge to see if they will do anything from my understanding on it isn't looking promising.
as the NTK does not comply would I first appeal to them so Horizon then if rejected ask to go to POPLA to raise this point with them?0 -
Appeal as keeper to Horizon on the basis that the NTK PCN letter doesnt comply with Pofa2012 so no keeper liability
If they reject it and issue a popla code, appeal to popla on a similar point, with other aspects too
If they stall asking for driver details, ignore the request
