UKPC unusual response to first appeal

Hello

Having never dealt with UKPC before, I thought their response to a first appeal via their portal was unusual but is this common with this and other companies? Obviously we will not be declaring who the driver was and I'll be sure to tell them this. In addition, they have instructed a response within 7 days from the date of the postal letter which in this case was 29th May and received on 5th June...7 days later.

Their response is below:

Thank you for your recent correspondence in relation to parking charge reference ****

To assist us in making a decision regarding your appeal, please confirm the full name and address of the driver to our Appeals Department within seven days of the date of this letter.

Schedule 4 of the Protection of Freedoms Act 2012 discusses the recovery of unpaid parking charges. It allows parking operators to hold the registered keeper liable to pay unpaid parking charges if the operator has not been provided the name and a serviceable address of the driver.

This information may be confirmed by submitting another appeal on our website at www.ukpcappeals.co.uk, or by post to the address overleaf. Please ensure that if writing to us by post that you include the parking charge reference number and vehicle registration.

Failure to provide this information will give us no alternative other, than to make our final decision based on the previous information received. At this stage a POPLA verification code will be provided.

The parking charge has been placed on hold whilst under appeal and may be settled in full at the current PCN rate of £60.00.

    I've never encountered this before. In the past, I have fought Smart Parking and NPM and usually receive a wordy "rejected....here's your POPLA code"

    As Above, not unusual, they are merely phishing for the drivers details, before either cancelling or issuing a POPLA code, a fairly common response

    You could just search the forum for a chunk of words from that very common reply!

    And don’t be expecting a POPLA code. Smart have joined the IPC where the second stage appeal (dis) service is provided by the IAS (don’t bother, they find in favour of operators in 96% of cases).

    This is fairly standard from UKPC and other private parking companies, they often ask for the driver details early on to try and make enforcement easier but as the registered keeper you are not obliged to name the driver, and they usually still have to continue the appeal process and give you a POPLA code if they reject it, so the 7 day wording is more of a pressure tactic than something that cuts off your rights, so just keep everything in writing and respond only as the keeper if you choose to reply at all.
