No POPLA code?

Hi all

I am currently helping a friend of my wife with 2 PCNs she received back in March. Having revisited the newbies thread, an appeal was sent to Total Parking Solutions via email to their info@ email address as I couldn't find an appeals portal on their website. In fact, when hitting the 'Appeals' page on their website, it only gives you the option to pay. In hindsight, I should have asked her to supply details from the back of the PCN!

Anyway, 2 appeals were submitted for two separate PCNS in March yet she never received a response or POPLA code. Of course the standard ZZPS and now threatening solicitors letters have been piling through. I've had a search on the forum but can we submit a complaint to the BPA for lack of POPLA this far down the line and taking into account the appeals could well have gone to the incorrect email address?

Any templates would be greatly appreciated.

Thanks guys

Yes you can complain but you gave to exhaust TPS' complaints policy first.

But why didn't you use the appeals portal shown on the back of the PCN?

"an appeal was sent to Total Parking Solutions via email to their info@ email address as I couldn't find an appeals portal on their website."

The PCN didn't tell you to go off and 'find' it on their website. You don't just go to their website and look around hoping to find a link. You could have appealed on the page that the PCN stated (this info is always on the back page). I appealed two TPS cases for friends a few months back and there were no issues.

    Anyway try the complaints first.

What's the cause of these PCNs? They do proceed to court & they do go all the way to hearings, so what's the defence?

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you Coupon Mad. I agree with all of that. It's been a good 8 years or so since I appealed a PCN and it just didn't even cross my mind to ask for a photo of the back of the PCN for details! What a tool....

She parked in a private car park to visit the dentist (surgery is not connected to the car park). She overstayed 30 minutes but didn't realise TPS had recently taken it over and applied terms after it used to be free with no maximum stay.

You maynot have found appeals portal on TPS website but you'll definitely find their complaints policy which will tell you how to submit a complaint.

"TPS had recently taken it over and applied terms after it used to be free with no maximum stay."

She should add to the complaint a second complaint:

    • that they failed to comply with the CoP clause whereby they had to put up mandatory additional 'new terms alert' signs for 4 months or longer, at the site entrance and elsewhere, prominently telling locals used to the old car park, that restrictions had changed/been introduced.

(She doesn't have to check or know this is true at that site. I could be wrong).

The point is to force them to prove it and if they don't, off she goes to the BPA with the complaint 'round 2'.

If they do prove it then it helps her understand her defence strengths or weaknesses, if they try a small claim.
