CEL small claims track stage
Hello, newbie here.
I am looking for advice
PCN from CEL in 2024 for an overstay in KFC car park.
Initially appealed but rejected. Ignored up until a letter received for a claim to the HM Court & tribunals Service.
A defense was filed with the key points:
1. Unclear signage ( occurred between 22:00-23:00) when it was dark
2. Being a genuine/paying customer using the premises/facilities as intended
3. Attempts to claim additional fees as as abuse of process/double recovery.
An email from CEL was then received with what sounds like standard threats of fees (270 ish). A reply was given outlining the defense points again
A notice of proposed allocation to small claims track has now been received and currently completing the N180 form
FYI claim is against the driver.
Any advice at this stage would be much appreciated!
Many thanks

Follow the advice in the 8 steps in the defence template thread in announcements near the top of the forum
Was it an in-house claim. ? Or via DCB LEGAL ?
How do they know its against the driver. ? Was it revealed previously. ?

Thank you, I'll have a look
I'm not sure but thinkinhouse. The email received with attached witness statement was from a claims manager addressed as from the legal team, for and on behalf of CEL? Is there anywhere else to check this?
The driver is not registered keeper so didn't want them to be involved!

If it only mentions CEL on the top left of the claim form then its an in-house claim, no 3rd party involved

But you can tell from your claim form that this is an in-house claim. It says CEL twice and no solicitor firm.
I know this is 'in-house' because of the template early WS that you describe. Discussed on other CEL claim threads.
They're bunging out a huge batch of claims at the moment but having lost their experienced ex-Wonga Head of Legal 6 months ago, it seems their reinvented rookie legal team is mainly discontinuing defended cases before hearings.
So, play the game.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I've found the thread on what to do next which is great so will go through process. Will come back with the witness statement if it's looking like it will go to hearing!
