Mediation - will DCB legal actually attend?

I received a PCN from UKPC last Sept for not parking within the markings of a bay. I was parked in a disabled bay and slightly over the hatched area. This was because this particular bay only had hatchings to one side of the vehicle and the only way for my passenger to exit the vehicle was if I parked on the hatchings.

Anyway it's got as far as court proceedings as I believe I have a cast iron defence. I was advised when I submitted my defence to accept mediation pre court hearing as it would give me a more favourable standing before a judge.

I've received an email to say mediation will take place (over the phone) on 18th June PM.

Will DCB Legal actually attend the mediation? as they don't appear to want to attend court.

Since I filed my defence I have received 18 phone calls from them asking if I would like to settle out of court for a reduced amount. I have said no on numerous occasions yet the phone calls persist. So today I have reported DCB to the Solicitors Regulation Authority for harassment of a vulnerable pensioner with these unsolicited phone calls.

I will have to wait and see if they do anything.

Yes, DCB LEGAL will be contacted by the mediation service, as will you, if you both answer

DCB Legal never attend court hearings in private parking company cases

Your reply to the mediation service mediator, will be, " thank you, no offers will be made, goodbye "

I realise that mediation is a waste of time as I'm not prepared to capitulate. I'm just going along with the game.

Good. Focussed complaints can tip off the SRA to actually investigate. Doubt they'll actually sanction them but no proper complaint is wasted.

Yes a young, wet-behind-the-ears paralegal takes these calls. But you aren't offering money, two minute call maximum, goodbye Mediator!

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It's JOLLY GOOD FUN WITH DCBL

Of course DCBL don't want to court with a rubbish UKPC case

And at mediation, if they offer a figure say thank you very much, I will give you my bank details where to pay me

Such is the sad joke of DCBL and mediation. They will discontinue anyway so unless DCBL are going to pay you

You were right going to the SRA but … it is an old boys club so do not expect a seious reply

They always "attend" mediation as that is the second and last time to obtain money.

No doubt half panic and pay up as soon as the court claim lands on the doormat.

Mediation is where they can mop up another batch. They won't get the £250 the initial panickers paid, but some more hundred quids are obtainable.

After that, the amount of time, effort and expense make it non-worthwhile to pursue, although the game of chicken where they discontinue at the eleventh hour will flush a few more payments out.
