CUP Enforcement requesting Transfer of Liability after appeal next steps
Hi all, hoping for some advice on what to do next. First time poster, long time lurker.
I received a PCN from CUP Enforcement at a site called Gnome House three times in a short time period. I submitted an appeal using the blue template from the sticky newbie thread, identifying myself as the keeper of the vehicle, but did not provide the driver’s details.
I’ve now received a response in attached image
Not sure on what steps to take going forward and the 14 day period had past by a few days
Any help appreciated. Happy to share the original PCN details if needed.

You don't have to tell them anything, they are fishing for the driver's details. This is most likely because their notice fails POFA. Wait for them to reject the original appeal and issue a POPLA code.

I don’t think we’ve seen a CUP NtK that is PoFA compliant (check yours against this thread - if it’s exactly the same, there can be no keeper liability, that’s why they are fishing for the driver’s identity). If there’s no keeper liability, there’s no need for you to be responding.

Ignore debt collector letters. Come back if you receive a court claim. Inform CUP of any change of address in the next 6 years.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
