DCB Legal - Defence.

Hey everyone. Firstly thanks again for the newbies sticky thread, it helped me disconinute my last parking charge... unfortunately DCB Legal at it again despite me beating them before... they never learn. I received court letters again for a new parking charge..

Before we get started the MCOL website says:

Noob question but does this mean I have about 48 hrs left?

I have attatched a picture of the "breach specified" part of the court letter. Does this very vague wording class as "not specifying the breach"? It is so vague and minimal... or is this enough for them to say the breach was specified?

I think the main core of my defence could be the signs. This will be the basis of my para 3. I have attatched photos of the signs that I could see from my route into the car park.

The very vague sign that you can see here is on the junction of Grange road/Marton road. I didnt enter the car park from here, I approached the car park from the other end of Grange road where the entrance is. So unless I entered from Marton road end how would I have seen that sign?

The other screenshots show one tiny sign mounted on a post that I did not even see. I had a fat guy in the passenger seat as I turned left into the entrance thay sign was in my blind spot, so my visibility was impared. There is a small P sign just past the entrance which otherwise if you're not driving passed it as if you came in from Marton road, merely looks liks a verticle strip |.

The P&D machines are located at the complete other end of the car park, by looking at these screenshots, you can probably guess why I didn't see them, as if there are vehicles parked infront of them you WOULD not see them.

Lastly the signs themselves aint even complient are they? They dont even display any fine costs or consequences, or even the pay in 14 bribe thing...

Upon leaving the car park, I walked straight accross the road to enter the gym. This is what the red arrow shows on the picture, suggesting that If I did not see that ONE sign then it was impossible for me to even know it was a paid car park.

    Smart Parking via DCB Legal, insufficient paid time, issue date 6th May, deadline is 4pm next Monday, 8th June

    The alleged Breach is pleaded, so use the Smart parking template by mse member meltof dated 12th April, no changes, as long as they weren't told who was driving ?

    There is a current tsunami of Smart Parking claims. So much so, that I now have copy & paste advice ready:

    Copy their version of a Smart Parking final defence posted on April 12th. 

    Don't copy & paste it here as we really don't want to keep being asked to check this defence in thread after thread, which has driven us regulars a bit mad in April/May with this current Smart Parking batch!
