ECP PCN Appeal Rejected - Is it worth appealing to POPLA? (England)
Hello,
I recently entered an ECP car park and the ANPR camera clocked me driving in at 13:37. In the time before paying I was searching for a space and then, unfortunately, my son was crying a lot so I had to spend some time settling him down, before then going over to one of the parking signs and ensure I'd got the correct parking site number before paying through the PaybyPhone app.
The time I paid for the ticket was 13:47, 10 minutes after I arrived. This was for a 5 hour stay
I got back to the car park before the expiry date of 18:47, but the ANPR camera clocked me going out at 18:49
I feel its all rather unfair to charge me £60 for this. I did not avoid payment and I've parked in this car park so many times without issue.
I've read about the consideration period rules having been changed in Feb 2025 of last year, do you think I have a strong case here? Is it worth appealing to POPLA?

So its ECP , 13.37 in and 18.47 out, a total of 312 minutes, with an allowance grace period at the end of a minimum of 10 minutes , so 5 hours and 12 minutes, 2 minutes over, but delays including the consideration period whilst attempting to pay for parking, very petty IMHO by ECP
Its definitely worth appealing to popla, based on that grace period aspect, plus difficulties paying, plus a clear intention to leave promptly, not bilking etc
Add no landowner authority etc in too
Ps, the charge is £100 , the maximum allowed, not £60

You'll never pay this even if you lose at POPLA so either give it a go now, or totally ignore the £170 threatograms.
No paying. You can just let a claim form arrive because they ALWAYS discontinue.
But to stop it all now:
Try a complaint to the retailer. The shop managers (yes, even those you didn't shop in) and also the property firm who runs the site.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
