Unfair Parking Ticket By Smart Parking Ltd

Hi everyone

I was sent a letter by debt collector company stating that i have a parking ticket for about £170 and that it’s fine included but the truth is i never received any parking ticket you know them yellow ticket they stick onto your car or any parking ticket letter the only letter I received was from debt collectors and I wasn’t aware of any parking ticket

Also their onsite ticket machine was broken when I parked there and i have a video proof of it with timstamped they sent me first letter regarding the ticket 54 days after the incident and when i appeal to smart parking they send me another letter stating my time for appeal is over and that if I don’t pay they will advise smart parking to take me to court

I’m willing to pay the original ticket fee but not the extra what do I do please help me I’m desperate

Study the 2nd post in the newbies sticky thread in announcements near the top of the forum

Email the LoC template response to the info@ email address for dcb legal

Wait for the inevitable N1SDT court claim pack from the CNBC in Northampton using MCOL to arrive in the post in due course

"the only letter I received was from debt collectors and I wasn’t aware of any parking ticket"

Usually because the registered keeper failed to update your V5C address when you moved.

    Logbook address out of date?

    That's almost always why.

However, Smart Parking have also been caught doing the scam whereby no PCN is posted. I know they were being investigated for that (and failing to provide POPLA Codes) by the BPA in recent years, which is probably why they hopped to the other trade body last year, the IPC, for the 95% promise of a (skewed in operators' favour) joke IAS appeal service.

You aren't desperate. This isn't urgent. These are easy.

Wait for the DCB Legal Claim Form like everyone else then defend using the template defence at that time. No hearing, no CCJ and it'll cost you nothing at all.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

And have you put the V5C error right with the DVLA or was this Smart Parking up to their tricks of pretending to send a NTK?

You are not 'willing to pay' the PCN. Honestly you will never have to pay a penny.

Just going through the court process with Smart Parking/DCB Legal. Retain everything communication you have received/they’ve sent/you’ve sent. Store it in a folder for when you need it if the court date comes.

Everyone gets a court date. Then all cases are discontinued.

Hi thank you for replying it was smart parking who never sent me the initial letter or ticket

Also i did receive an email from smart parking a week ago saying they apologised for not receiving the first letter and attached the photo with the original claim and also said that they ordered the debt collection company to stop chase and they reduced the amount to £100 to which we replied that it wasn’t our fault since your own machine was broken and that we’re willing to pay the original £5 fee but not the extra to which they replied yesterday that they’ve stopped the investigation and decided to uphold the Parking Charge and that they Will further not investigate this case

    What do I do now

I thought you never get to that point most cases discontinue when you put your case online? What are the chances of getting your case to actual court hearing and if you do does it cost money if so how much per hearing?

Zero chance of a court hearing. Won't happen. All Smart claims are discontinued.

Irrelevant to you but post 2 of the NEWBIES thread already tells you the worst case scenario of £212 at a lost hearing.
