So refer their response to FOS. I know that you had an immediate success with a previous complaint but that was unusual. Most lenders try to justify their decision and usually it's only FOS that will rule in your favour.

Well if you have cause to doubt what they say, or if you think the FOS will reach a different conclusion, you should escalate the matter and see how the dice roll.

were you in financail difficulty when you took this MCB loan? Did you use it for consolidation?

We can see you have been in a DMP since March 2025, and we rescheduled your loan in December 2025 to align with your DMP payment amount.

That sounds a bit of an odd statement. How much are they being paid a month in the DMP? How does this show on your credit record? What was the balance going into the DMP and what is it now/

Hi all thanka for the replies.

It would have been used to shore up other areas yes as i was robbimg peter to pay paul at the time.

The other odd bit was they said i was managing my finances well at the time from my credit record, yet my overdraft was at 5k at time and maxed out as well as my credit card which was also maxed out at 5k. Hardly managing well!

They get £39pm and their original payment was £86pm.

It shows as being in default on my credit record now. Doesnt show anything else? Should it.

Since my DMP started theye had £362 paid to them and balance was £2,060. Balance is now £1,702

Then I suggest you send this to the ombudsman.

That sounds OK; the balance has dropped by what is paid in. I wondered from that rather odd phrasing if they had decided to charge their normal high interest rate over all the extra years your DMp would take, but that isnt a problem here.

I’ve just sent all of mine to FOS regardless of the response detail. Their response doesn’t change the fact I believe they lent irresponsibly and I couldn’t afford it. It is a faff but I assume that’s why they largely find not in your favour. I imagine a fair few drop off at that point so it’s a worthwhile exercise.

    Hi Arty,

I am quite new to this to be honest, so I am just feeling my way through what to do for the best. Whether it is worth appealing the rejected ones. The advice on here and hearing others stories is most helpful for this.

I was planning to appeal them as thought few would not bother appealing theirs and companies will benefit from this rather than paying every claim out.

You don't have anything to lose by sending it to the FOS. It's pretty standard for lenders to reject the initial complaint as they just want you to give up, usually dragging it out for the whole 8 weeks to make it as difficult as possible for you. All the complaints I won were initially rejected by the lender.
