NCP/Moorside County Court Claim

Hi ,

I've been served by NCP via Moorside for multiple unpaid PCN's. I am unsure how many, going to make an SAR.

PoC is breach of T+C's.

My aim is to win on technicality by contesting validity of the T+C's.

I plan to submit the template defence posted by Coupon mad.

  1. Any thing I could add to the defence to strengthen it?
  2. Will the company's current status (in adminstration) have any effect on this case reaching a hearing?
  3. The claimed amount (minus court and legal fees) is around £500. If I lose the case will it be likely I'll have to pay this full amount?

Many thanks

Dont submit a SAR at this time, defend against the POC from the lower left of the claim form

Post the Issue date from the top right of the claim form below

Post a redacted picture of the POC from the lower left of the claim form below after hiding the VRM details first

Yes their current administration could have an effect later on

If you lost in court, its likely to be £140 or more LESS than the claimed total, but a judge would decide

    There will be no judge.

NCP are in Administration so read other Moorside NCP defence threads and include the relevant wording about that in para 3. Examples were written in April.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So 2 x £100 pcns, no dates, just a timespan, plus extras and costs, debt collectors fees plus interest

No breach pleaded, so use the Chan and Akande defence template, no changes, no additions

"1. £510.00 being the total of the PCNs."

Just checking - would that be for 3 pcn,s?

Yes (it will be) but the POC fails to even state how many PCNs, let alone three stated terms and alleged breaches.

    And this spans a YEAR!

"Charges were issued between xx/xx/2024 and xx/xx/2025"

That should be added to the Chan & Akande version, along with the wording already written in other NCP claim threads about Administration.

This'll never reach a hearing but you have to play the game to see it off.

Thanks guys. Should I send the defence now or just let them wait? I've technically got until the latter half of June to send it.

Its irrelevant, waiting doesn't really change anything
