Protective award as only employee

Hi, I was recently made redundant from a company that I worked for, for almost 4 years. At the time of being made redundant, I was the only employee with 2 directors.

I was informed on a Friday afternoon that the company was insolvent and that I was being made redundant with immediate effect. No consultation was made leading up to this and I was not aware that things were that bad.


I have read about the protective award, but can’t find much information when it is less than 20 employees being made redundant.

How do I make a claim as the sole employee of a company?

    Really sorry to hear, must be stressful to find yourself suddenly unemployed.

    Did you get any redundancy pay? If not, you might be able to make a claim here

    Does your contract stipulate any notice period or holidays? You might be able to claim that too.

    From recollection protective awards only apply in cases where there are more than 20 employees involved.

    In your case I would concentrate on making sure you get any redundancy payment due and looking for a new job.

    Unless I am out of date there is some limited government protection for redundancy pay due from insolvent employers. However, from memory, you will be expected to minimise your losses by making all reasonable efforts to find alternative employment (any job at all). Your Jobcenter should be able to advise.
