PCN NTK from Excel Parking.

Hello all 😃
My partner received a parking fine because stayed too long in the parking area 🙃 and we are currently appealing it. Standard PCN, pics of a car with time/date stamps reason as:

80) PARKED FOR LONGER THAN MAXIMUM PERIOD PERMITTED.
Below is the message I previously sent.

I have selected ‘I was authorised to park’ as the closest available choice, but it does not fully reflect my grounds for this appeal. My actual complaint concerns the lack of evidence supporting the alleged overstay, including absence of maximum stay duration, grace period and signage.

I dispute liability for this PCN as the keeper of the vehicle. The evidence provided only shows my vehicle and timestamps but does not demonstrate any breach. No maximum stay duration or grace period has been provided, and the PCN fails to explain the alleged contravention. I deny any liability until full evidence is supplied.

Please provide:
• Evidence of the maximum permitted parking duration at the site.
• The agreed grace period, if any.
• A close-up photograph of the signage present at the location on the material date.
• Any additional evidence that substantiates the alleged overstay.

No admissions are made regarding who was driving and no assumptions should be drawn. Since your PCN is a vague template, I require a full explanation of the allegation and supporting evidence.

Until full evidence is supplied, including maximum stay and grace period, I deny any liability. I also reserve the right to make a formal complaint to your client landowner regarding predatory conduct should sufficient evidence not be provided.

I’ve now received a reply, but I’m not fully sure how to respond to it. I wanted to ask for your suggestions on what would be the best reply.

We refer to correspondence received from you concerning the above numbered Charge Notice.
Please note that responsibility for this Charge lies with the driver of the vehicle at the time the parking contravention
was observed. However, we are unable to ascertain who the driver was on the date in questions from the information
given within your appeal.
In order for us to process your appeal correctly, please follow the instructions below:

If you were the driver on the day in question, please confirm this within your next correspondence.

Notify the driver of the vehicle that they will need to appeal to us directly, including their FULL NAME (Forename
and Surname) and a valid FULL RESIDENTIAL ADDRESS within 14 days.

If you are representing the driver we require a signed and dated statement from the driver of the vehicle confirming
that you are authorised to appeal on his/her behalf; this needs to be an original signature and not a photocopy or a
stamp. The statement MUST contain the drivers FULL NAME (Forename and Surname) and a valid FULL
RESIDENTIAL ADDRESS.
Please ensure that correspondence is submitted through the portal www.myparkingcharge.co.uk in order to correctly
adhere with the appeals process.

OR

Pay the PCN. Payments can be made online at www.myparkingcharge.co.uk by following the links for "Pay Now",
or over the phone by calling 0845 226 9138 and using a valid Credit or Debit Card to make payment. It is your
responsibility to ensure that payment is received within our office by the date specified.
As a gesture of goodwill we have placed the charge on hold for an additional period of 14 Days to enable one of the
above actions to be complied with.
We are willing to re-offer you the original discounted charge of £60.00 as full and final settlement of this Notice, if
payment is received within our office on or before the 08/06/2026
If payment is not received by this date, the amount payable will revert to £100.00, payable by 22/06/2026. Failure to
pay this charge within the stated times, may result in Debt Recovery action being taken and further costs up to an
additional £70.00 being incurred.

What would your suggestions be in this situation?

Regarding the 14-day deadline - does it start counting from now already, or if they reply again, would we get another 14 days from their next response?

Also, I recently finally managed to find contact details for the landowner. I submitted a complaint and I’m currently waiting for their response as well.

Ignore them, no further contact, regardless, stop overthinking it

As for your last sentence, plan A is always the best option, so wait and see

You realise it's a complete farce and you'll get a rejection to ANY 'appeal'? They only make money from fake penalties (they aren't paid by the landowner) so this won't be cancelled.

You need to start IGNORING them. The recipient of the letters only contacts EXCEL and their daft debt crawlers if you move house … and of course, if you get a Letter before/of Claim, as discussed in post 2 of the NEWBIES FAQS thread.

Stop taking the bait and thinking you have to 'appeal'. There's no 14 day 'deadline' that you care about. Stop reading their template crap like it matters.

Read post 4 then post 2 of the NEWBIES thread.

Sorry, I don’t really have any experience with this kind of thing.

I’ve read through everything, but there’s a lot of information to take in, so I’m still a bit confused at times. She is the owner of the car and she was also the driver at the time. There was no option to extend the parking time, and the shopping ended up taking around 30 minutes longer because of traffic and queues (the parking itself was free of charge).

So if I understand everything correctly, this is now heading towards a small claims court hearing? Even with all that, is there still a chance that Excel could cancel/discontinue the claim before the hearing, or is it more likely that they will go ahead with it?

Its currently nowhere near a court hearing

They should complain about it to the landowner or landlord or business and try to get it cancelled ASAP

There is no valid appeal option

Yes they may issue a Money Claim using MCOL and yes they usually take it as far as a hearing in the keepers local civil court

When you write "owner" do you mean "registered keeper?

Ok, thanks for the info. I already found the landlord and sent a complaint about it. How likely is it that I could win such a case?

    Yes.

"How likely is it that I could win such a case?"

How long was the overstay and were there any disabled people in the car?

The overstay was almost 30 minutes (and it’s not the first time she lost track of time while shopping - like some people do in casinos🤪). There weren’t any disabled people in the car.

The good news is that we received a response from the landlord/the responsible company. They were super nice throughout the whole correspondence and said they would get the charge cancelled.

    Great! Plan A strikes again.

Tell her always to read signs, never overstay and where possible DON'T use private car parks at all.

Use council car parks or on-street (paid or free on Sundays) parking when shopping.
