Britannia Parking - NTK Received
This is the wording:
We are writing to inform you that a Parking Charge has been issued to the above vehicle for the following breach of the terms and conditions:
Failed to display a valid P&D ticket or Permit.
The signage displayed at the entrance and throughout states that the site is private land managed by Britannia Parking (the creditor). The conditions detailed on the signage (Parking Charge Contract) must be adhered to, or a Parking Charge will be issued. By parking, waiting or otherwise remaining on the land the Motorist is thereby agreeing to comply with the parking contract. This Parking Charge occurred on private land and issued in accordance with the requirements of the BPA’s Code of Practice for Private Parking.
As the motorist has contravened the terms and conditions detailed on the signage, a Parking Charge has been issued. You have 28 days to pay, appeal or transfer liability from the date of this notice.
Failure to pay the full amount of this notice may result in the proceeding of debt recovery action and/or issuing court proceedings against you.

The car was parked at a train station's car park without a ticket/reg plate put on a machine.
Date of Contravention: 14-May-2026
Date of Notice: 18-May-2026
Paid by Date: 15-Jun-2026
NTK Arrived on: 26-May-2026
As per the newbies thread, I gather I just go ahead with the "TEMPLATE ''ONE SIZE FITS ALL'' FIRST APPEAL THAT DOESN'T SAY WHO WAS DRIVING"
Is this correct?
Thanks in advance.

Yes, correct, but check if the NTK PCN letter complies with Pofa2012 or not, first, because that is important too

Hi Gr1pr.

From my understanding, the post needs to arrive between 14-29 days after the event. They haven't named the driver aside from addressing the letter to the keeper with a postal address. Finally, it gives me the right to appeal, so I believe I'm okay to use the template as originally quoted?

They Issued the NTK PCN letter 4 days after the incident date, so we'll within the 14 days delivery date required by Pofa2012 ( not 14 to 29 days. )
Wording is also important under POFA, not just dates or deadlines
They haven't a clue who was driving, ergo it's impossible for them to name the driver, so they posted it to the name and address listed on the DVLA database, the Registered Keeper, presumably you
You should have compared your NTK PCN letter ( both sides. ) to the pictures in the thread by coupon mad, which lists compliant and non compliant NTK PCN'S, not just dates and deadlines

"From my understanding, the post needs to arrive between 14-29 days after the event."
That's not the be-all and end-all of POFA!
I put a link in the NEWBIES thread to check if a NTK is POFA compliant or not, for a reason. It's not merely about dates.

Hi Gr1pr and Coupon. Thanks for your responses. I have attached the both sides of the received NTK, so please let me know if I have missed anything below.
As per the Newbies sticky, I’ve checked the Britannia Parking NTK against POFA Schedule 4 paragraph 9 (Postal PCN NTK) and it looks like there may be no keeper liability. The main issue appears to be paragraph 9(2)(f). The NTK does not appear to contain the mandatory warning that after 28 days the creditor will have the right to recover the unpaid charge from the keeper if the driver is not named.
Instead, it only says things like:
- “You have 28 days to pay, appeal or transfer liability”
- “Failure to pay may result in debt recovery action and/or court proceedings”
It never explicitly states that keeper liability is being invoked under POFA Schedule 4.
There also seems to be a possible paragraph 9(2)(a) issue because the NTK only states “Observed from” and “Observed to” times, rather than specifying an actual “period of parking”. From what I understand, entry/exit or observation times are not necessarily the same thing as a parking period.
The NTK was issued within 14 days, so timing under 9(4)/(5) appears compliant.
Does this look like a valid “no keeper liability” POFA appeal point, or should I take a different approach?
If the former "no keeper liability" approach is correct, I assume I use the,TEMPLATE ''ONE SIZE FITS ALL'' FIRST APPEAL THAT DOESN'T SAY WHO WAS DRIVING:?
Thanks in advance!1 -
"The main issue appears to be paragraph 9(2)(f). The NTK does not appear to contain the mandatory warning that after 28 days the creditor will have the right to recover the unpaid charge from the keeper if the driver is not named."
Yep, non-POFA wording.
The main issue is always the lack of 9(2)f and for some unknown reason, Britannia often do this. One of my friends' husbands got nine or ten of these in the post last year (he parked like an idiot and I had a word to educate him in future, not to do that!) and all ten were non-POFA worded for no discernible reason.
All knocked down like ninepins at POPLA.
Easy, innit?!

Definitely, you and Gr1pr have made it much simpler - thank you! I'll use the template on your thread and will respond when/if this is revoked!

…or use this appeal wording that I used:
You have sent a non-POFA NTK so you have no cause of action against me, the registered keeper.
Under contract law there is no lawful presumption that the keeper was the driver. This was tested on appeal and the parking firm lost (VCS v Ian Edward).
Kindly don't insult me with your template letter asking who was driving. Send me a POPLA code, or cancel.

Hi @Coupon-mad,
They finally responded today with this:
Is it right for me to assume that I can just push them to send me a popla code? They have assumed the "probability that the keeper was the driver if the keeper".
Thanks in advance!

Ignore them, wait for a cancellation or a popla code
