    Best to establish with the lender when the current mortgage is due to come to an end.

    I note you wish to sell up and move on, but best to ensure you don't have any time pressures to do so by reason of a potential looming mortgage redemption date.

    in the worst scenario of repossession then yes their would be enough funds. X

    There is enough from the sale to pay the mortgage off,I want to sell anyway. X

    If you want to move anyway, then I’d put the house on the market now. Price realistically for a quick sale and hope you find a buyer. Probate should come through soon and the lender is unlikely to repossess of you have a buyer lined up.

    Separately, and maybe when all this is done and dusted, I’d put a complaint in to the solicitor. They should no the rules about attaching documents to a will and their mistake has cost you time and hassle and may have cost you more interest on the mortgage.

    I have left my son to deal with the solicitor, as I m too stressed to do it myself. My solicitor left me an email today saying she has written to probate now. But she also said that 2 weeks ago and probate hadn't heard from my solicitor since November last year. So hopefully she's telling me the truth now. Thank you for the information. The reason I accepted the hold on the mortgage was, after my husband passed away I found he hadn't paid any house bills for 14 months, toffunc his alcohol. so I have been paying them off with overtime. This is the reason I want to sell mostly to start a fresh. Thank you for your help. I'll let my son talk to the solicitor.
