Letter of repossession before probate has been granted

    They are required to get the best price they can, in a reasonable time. They will load deduct all the accrued interest and their charges to repossess. If you intend selling the property once you have probate, then it may not be the worst option. I wouldn’t leave yourself short of money while this is happening, and if you live elsewhere I wouldn’t mortgage your own property to pay yet mortgage on what was his property.

    I agree, changing now is probably going to cause more problems.

    But maybe call the solicitor and let them know you are getting frustrated with the delays and hold ups which appear to be caused by them - it might just mark their cards and get them to go above and beyond for the remainder.

    They will put it to auction most likely and get what they can for it. But the auction house will want paying, solicitors will need paying, extra interest, late fees etc - it will all add up so best to try and keep on top of it.

    You indicate the mortgage is interest only, what was the original mortgage term and how close to the mortgage termination date are you?

    I agree with others that you should recommence mortgage interest payments ASAP, not only to prevent repossession formalities but also to protect your ability to potentially borrow from another lender when the current mortgage term comes to an end.

    Hopefully there is significant equity in the property, and you have sufficient income resources of your own to meet future mortgage obligations if it proves to necessary to move on to capital repayment terms, rather then problematic interest only mortgage currently in place.

    I’m unclear whether you live in the property that the lender wants to repo? Or whether you live elsewhere.

    I’ve just spoken to another solicitor and they’ve told me the whole process will have to start all over again.

    My late husband appointed me as executor,we had mirror wills, probate is questioning a staple mark on the will,something the solicitor did when stapling my husbands death certificate and marriage certificate to the Will.

    I live in the family home I shared with my husband and children for the last 20 years.This is the property they want to repossess.

    My son is going to call the solicitor tomorrow, hopefully we will get somewhere, as all it’s gonna take is a written letter to probate to get this Will problem solved. With all this heat I feel like I’m already in hell.

    I’ve just spoken today to co-op solicitors and they said the same thing,new solicitors would have to start the process all over again. It sucks, my son is going to try and get through to my solicitor tomorrow.

    I started paying the mortgage in April 2026 after a year of being put on hold. I’m hoping this helps my situation until probate is given. I want to sell anyway and move away,my husband as much as I loved him for 31 years was an alcoholic and memories here aren’t all that happy. I’m not sure about the term length of the mortgage never thought to ask.
