is this an excepted estate
I was hoping I could avoind filling in IHT400 and just go straight for C1 as there is no inheritance tax due after Dad's death. However now I am not so sure about filling in the IHT form, I am certain no inheritance tax is due.
Dad's will leaves everything to Mum.
House deeds unfortunately has no survivorship clause, therefore it is listed on C1 heritable estate in Scotland at a half share of a valuation by a local estate agent.
The moveable assets total are less than £325000 but if you add on the half value of the house it is more than £325000, but less than £500000.
Does the value of the house get added to the moveable assets and because it is more than £325000, does this mean I have to fill in IHT400.
To complicate matters further, we three children, two of whom are executors, plan to take legitim, right to inherit after confirmation.
Do I have to fill in IHT400 before applying for confirmation?

Even though legitim will be claimed, the moveable estate is less than £325,000 therefore the NQV will be less than the IHT threshold and, on the face of it, this is an exempt excepted estate and IHT400 is not required.
