Signing a Waiver

we are due to travel to Dubai end June and have been told by Gold Star which is a third party trade ticketing agent for our travel agent we have to sign a waiver to say we still want to go despite the FCDO , even though we don’t, or we lose £1800 on Tuesday. I can’t lose this amount of money, they have told us we have to sign it. Are they allowed to make us to do this ? We just want a refund but they won’t give it unless we sign the waiver. Please help thank you

Not an expert here, but perhaps the travel company can only refund you if "they" cancel the booking, and in order for them be the ones who are "forced" to cancel it, you have to confirm that you don't want to cancel (i.e. you are not the party instigating the cancellation)?

I've seen far stranger contractual requirements before in order to tick all the necessary boxes.

If the OP tells the travel company they don't want to travel they are likely to lose any entitlement to refund as it will be classed as 'disinclined to travel'. Keep wording in any communication as 'FCDO has advised against travel'

They aren’t being asked to say they don’t want to travel (even though they don’t.)

They are being asked to sign to say they do want to go, despite the foreign office advice.

OP ask them to show you the terms and conditions that makes their request necessary (in their eyes).

I have now been told not to sign the waiver so I haven’t and I won’t as we don’t want to fly. Most travel agents will give you a refund due to the current war situation! I explained to our travel agent that we cancelled other flights in March and got a full refund so she has now escalated this and will add what happens. Thank everyone for your advice and comments .

If this is a package holiday then it is likely to be cancelled/cancellable if the FCDO advice is in place for your travel date…at this point nobody knows whether that will be the situation or not. It may be worth checking at which point will they take the decision…..eg FCDO in place 7 days before departure, 3 days before depature, day before departure?

Hi we are Now getting a full refund but it hasn’t been without its issues ! They were genuine going to take our deposit unless we rebooked with them. Thankfully after a lot of emails it will be refunded.
