Court claim for 2023 PCN

Hi,

Hopefully someone can assist.

Received a letter of claim from DCB Legal saying they wanted £170 for a pcn from 3 years ago.

This was the first letter I had received regarding this so I probably foolishly phoned them asking what this was about.

Lady on the phone said it was for non payment of parking somewhere I honestly can’t remember having ever been to.

On their letter it said insufficient time paid. So after asking again she said it was insufficient time paid.
I asked what evidence there was of and she emailed me 2 photos of my vehicle that anyone of 4 people could have been driving but none of us can remember going there and it’s not clear from the pictures who is.
Pictures say there was an overstay of 18 minutes and I found out that the parking cost 70p an hour.

She went on to say I was liable as keeper and would I like to pay them £170 or possibly be taken to court.

I declined and that ended the conversation.


I now have a Claim form from Civil national business centre Northampton with a county court stamp on asking for £298.31

Am I stuffed here or do I have a response to this?

I’ve looked through the pinned posts about this but I’m still a bit confused and not certain what would apply if anything.

    You defend yourself

    Name the private parking company claimant involved and post te issue date from the top right of the claim form below

    Post a redacted picture of the POC from the lower left of the claim form below after hiding the VRM details first

    Check your V5c to make sure that your current details are correct

    The company is Smart Parking Limited

    Issue date is 13 May 2026

    I’ve attached the POC

    I sold the car on 11th of August 2025 and I know the details are correct.

    Login to MCOL via your government gateway account and complete the AOS online stage ASAP, details in the 8 steps in the defence template thread in announcements near the top of the forum

    Then copy and paste the template defence by member meltof posted on 12th April into the defence box on MCOL, save it and submit it

    Defending these is dead easy!

    Copy their version of a Smart Parking final defence posted on April 12th.

    No changes. No added facts.

    Don't copy & paste it here as we really don't want to keep being asked to check this defence in thread after thread in May, which is driving us regulars a bit mad with this current Smart Parking batch!
