Heathrow drop off PCN £40 APCOA Cancelled
Dear all,
I forgot to pay the drop off charge at LHR on mid April 26. Received a PCN for £40.
Appealed on line as per recommended template, submitted on 1 May 26.
I appeal as keeper. I am not obliged to identify the driver, and I decline to do so. I appeal on the following
grounds:
- You are unable to transfer liability to the keeper pursuant to Schedule 4 to the Protection of Freedoms
Act 2012 ('POFA') because the drop-off zones at Heathrow are not ‘relevant land’ as defined in POFA. - Even if (which is not the case) the land in question is relevant land, your notice does not conform to the
requirements set out in POFA paragraph 9(2)(f).
Furthermore, as keeper, I am entitled to all the defences available to the driver, including (without limitation)
the following: - The parking charge is not notified until after the contract is entered into and, under the principles set out
by the Court of Appeal in Thornton v Shoe Lane Parking, does not form part of the contract between the
driver and APCOA. - The signage is not compliant with the BPA Code of Practice.
Any one of the above reasons is alone sufficient to require cancellation of the PCN.
I require you to cancel the PCN or issue a POPLA Code so POPLA can order you to cancel it.
Today (18 May) I received this reply:

CONTRAVENTION DATE: xx April 2026
Thank you for your letter received on 01 May 2026 regarding the above Parking Charge (PC).
In your appeal you have explained that you are the registered keeper of the vehicle and declined the invitation to provide us
with the full name and address of the driver.
On this occasion we are prepared to exercise our discretion and have now cancelled this Parking Charge but must inform
you that the terms and conditions in this location advise the driver that they must pay for each visit to the site.
Signage is
displayed at the approach to this drop off area, along the location and upon exit, advising all motorists that a payment to use
the drop off area is required to be made online or by phone. As stated above, the terms and conditions of using the drop-off
zones are displayed by way of clear signage. It is the responsibility of the motorist to read and comply with the signage on
site.
Please retain this letter as proof of cancellation, should you need it in the future.

We have carefully reviewed your appeal and the evidence provided, taking into consideration all the
points you have raised.
In your appeal you have explained that you are the registered keeper of the vehicle and declined the

On this occasion we are prepared to exercise our discretion and have now cancelled this Parking Charge
but must inform you that the terms and conditions in this location advise the driver that they must pay for
each visit to the site.
The Heathrow Terminal Drop-Off Zone operates within a chargeable area. A charge of £7.00 applies for
each visit.
Payment must be made online or via the automated telephone service by midnight on the day following
the visit. Payments may also be made in advance, with prepaid credit remaining valid for 12 months. An
Autopay option is also available.
The site is monitored using ANPR cameras, which record vehicle registrations on entry and exit.
Payments must therefore be made using the correct vehicle registration number.
Failure to make a valid payment in accordance with the terms and conditions may result in a Parking
Charge being issued.
As this Parking Charge has been cancelled, no further action is required.
