“Parking Charge”
Advice please: we parked at Manchester airport multi storey P12 on 30th April to 5th May. The signage to P12 seemed ok until we were almost there. We passed the car park entrance and had to go round a roundabout again. It seemed fine - until we received ‘Parking Charge APCOA Parking’ today (18th May) dated 9th May.
It states ‘Use of Pick up/drop off zone without making a valid payment. At Manchester Airport Lower Drop Forecourt T1’
Time is 8:47:12 to 8:48:17 on 30/4.
We did not stop for 1 minute 5 seconds and did not drop anyone off or pick anyone up.
Clearly it’s taken 9 days to arrive here, possibly delays with post so I’ll have to be quick.
Yes we did park there that day but if we were in drop off zone it’s a genuine mistake.
Any advice would be appreciated & thanks in advance

Read the recent airport threads on here, especially Manchester Airport ones, or the Heathrow Gatwick Manchester airport group thread, appeal as keeper to Apcoa using the no keeper liability under POFA on airport land appeal template

(Curranv1) Hi thanks for advice. I replied as keeper of vehicle but added photos of car in P12 multi storey and confirmation of parking there and costs. I refuted any suggestion that car picked up or dropped anyone off. I’ve received email today thanking me for info and asking for name and address of the driver. The fine is ridiculous as we were genuinely trying to get to P12 and not the T1 drop off area. If I reply without divulging driver info will that be the end of it - or will they refer to court action? Obviously this is new to me - thanks - Val

Definitely do not reveal who was driving
Its not a fine
Wait until after their deadline to name the driver
Or
Reply with the standard Manchester airport template appeal as seen in other recent Manchester cases

Thanks for quick reply. So, what’s the purpose of naming the driver after the deadline? Doesn’t that increase the charge? Why is it not a fine?
My response was going to be - I’m not naming driver; resending proof of parking at Manchester P12; reiterating car did not pick up or drop off at T1; will that suffice?
£60 for a genuine error is ridiculous! Thanks again0 -
Naming the driver throws them under the bus, so do not dob them in unless you really want to ( normally you never reveal who was driving to a private parking company )
The actual charge never increases, its stated as £100 on the pcn, so doesn't change at all
Magistrates issue fines, in court or by court letter ! You definitely do not have a fine, just an invoice from Apcoa for the alleged breach of the contract on that private airport property, which is subject to bylaws ( as are ALL airports. ) you definitely wont find the legal word "fine" on any paperwork or on the signs
Personally I might respond stating that I will not name the driver and airport land is not subject to POFA2012 so as keeper I have no liability, so cancel the pcn
Or copy and paste the airport template regarding Pofa2012 and no keeper liability and state that you will not be naming the driver so cancel the pcn
This case isn't about what happened or your personal feelings, its about Pofa2012 and no keeper liability

"So, what’s the purpose of naming the driver after the deadline?"
That's not what he meant! Must admit when I read that reply yesterday, I did also think it could be misunderstood.
NOBODY IS SAYING NAME THE DRIVER!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

As Above, the point is that they were phishing for the drivers details, sneaky peek, so if you were going to name the driver ( which isn't recommended. ) you would do so if they didn't cancel after the deadline expires
But
You really should either
Respond in the manner I outlined, as keeper with no liability and no you are not naming the driver
Or
You IGNORE the phishing response
If you had appealed as keeper using our airport special template appeal, they would have cancelled the pcn straightaway, knowing that they were on another lower
They were hoping that you were gullible and naive enough to dob in the driver

Thanks a lot for all the advice. If I reply simply stating ‘I’m not naming driver and under no obligation to do so’ - any idea what their likely response will be? Is there anything they can progress with? Thanks

Appeal as the keeper
use this one as per norrmal. not sure why anything else has been advised
This is an appeal by the registered keeper - No driver details will be given. Please do not bother with your known fishing expedition in an attempt to get driver details to try and get around the fact there is no keeper liability (and never can be under POFA).
Due to this being airport land you will be well aware there is no keeper liability due to the byelaws in force and the fact this is not relevant land.
As there is no keeper liability then liability cannot flow from the driver to the keeper and thus is an auto win @POPLA . Please therefore cancel the notice or issue a POPLA code where you will auto withdraw
If you waste your time asking for driver details this will be ignored and you will still lose at POPLA if you dont cancel the PCN
So let's save my time and yours and cancel this PCN you simply cannot win this (and you know it).
