Civil Enforcement Limitied - Claim Form
Hi people, I mistakenly posted the below on an existing thread, so I'm starting this new one which is about PCNs my dad received some time ago.
For a bit of background, my dad is not far off 90 years old and we did unfortunately pay one of the extortionate PCNs from CEL a couple of years ago. He’s got two more outstanding: one at Letter Before Action stage and one at Claim Form stage. All for the same residential site where he regularly visits his mate of a similar age.
I've attached the Claim Form, personal details redacted, including Particulars of Claim details. It was issued 21 April 2026; AOS was completed on the MCOL site on 5 May, and reading the info on this forum I think that means we have until 16:00 on 25 May to ensure the defence is submitted. I intend to do submit the defence sooner, unless it is better to wait?
I have read some other threads and seen what avenues of responses are advised but are we better off waiting for the Letter of Action to reach the Claim Form stage?
Thank you for already clarifying in the other thread that "He doesn't have to admit to being the driver, no legal requirement. He can voluntarily add and driver to the end of paragraph 2 if he wants to clarify that aspect."
We have an email from the property company that managed the site at the time acknowledging receipt of his name and car reg, as they were supposed to pass the info to the parking company, to ensure the vehicle would be exempt from parking restrictions. Presumably this was never done. To this end:
- Should this be stated as part of the defence against the POC in paragraph 3?
- If not, should the email be attached to the defence in MCOL or kept for any potential future hearing?
- Or, should paragraph 3 only cite the two cases of Chan and Akande, and be left at that?
I can see from other threads this is a busy forum and I'd appreciate any help you can offer.

A Letter Before Claim pre-dates a claim form, so too late for that stage
The defendant must defend an active Money Claim, as in this case above

I may not have been clear. They're for different PCNs. One PCN is at Letter before Action whereas the other has progressed to Claim Form stage.

The LoC letter is dealt with by reading and following the advice in post 2 in the newbies sticky thread in announcements near the top of the forum, respond and then wait for the claim form
The current priority is the court case mentioned in this thread

Just use the special Template Defence with the para 3 specific to CEL in-house claims. It's linked twice in the Template Defence thread.
Doesn't need us to check it, so please don't post it here.
