Claim Form letter for parking charge in 2022

Hi there,

I've had Claim Form letter through the post from HM Courts and Tribunals service, with a money claim against me for a parking charge in 2022. I've already done the AOS.

The claimant is Smart Parking Limited, and their address for sending documents is DCB Legal.

This is the first correspondence I have received.Since the time of the Parking Charge (18/06/2022), I have not moved house since then and still have this vehicle.

The parking was at the Willen Lake Car Park.

Some back story -

I didn't see the parking notice when I entered the parking area as I was rushing to pick my kid. I had spent around 13 - 15 minutes and was on my way out of the park when I saw the sign, so I stopped and made payment for 30 mins and I exited immediately. So I spent less time than I paid for.

Claim Form Details -

The Issue date is 06 May 2026.

Particulars of Claim:

  1. The Defendant (D) is indebted to the Claimant (C) for a Parking Charge (PC) issued to vehicle [Car Reg] at Willen Lake Car Park B (North).
  2. The date of contravention is 18/06/2022 and the D was issued with a PC by the Claimant
  3. The Defendant is pursued as the driver of the vehicle for breach of the terms on the signs (the contract). Reason: Failed to Pay For Sufficient Time.
  4. In the alternative the Defendant is pursued as the keeper pursuant to POFA 2012, Schedule 4.

AND THE CLAIMANT CLAIMS

  1. £120.00 being the total of the PC and damages.
  2. Interest at a rate of 8.00% per annum pursuant to s.69 of the County Courts Act 1984 from the date hereof at a daily rate of £0.03 until judgment or sooner payment.
  3. Costs and court fees

The amount being claimed, shown in the table on the bottom right of the form is £161.67, plus court fee and legal representative's cost.

What I've done -

I have completed the AOS.

What to do next -

I'm asking for advice on what my defence should be.

    It'll be discontinued anyway.

For paragraph 3 you can simply put

"The claimant's particulars state the claim is regarding "failed to pay for sufficient time". This is completely false. The defendant paid £xx for 30 minutes parking time."

Defend what they claim for, not what you think they might be. They could have argued their case properly, but it's just a robo-claim so they don't bother.

I would not put that because that says who was driving and Smart never used the POFA in 2022.

Smart Parking - easy! - so you just completely copy the defence by @Meltof which they posted last month near the end of the Smart Parking Claim Defence Group thread.

Search and ye shall find! No link given.

With an issue date of 06/05/26 and having completed the AoS in a timely manner your defence deadline date is 4.00 p.m. on 08/06/26

  • Thank you fellas. I have now put in the defence as is.
