LDK Group Ltd - GCTT transfer to solicitors letter

Hi,

I can see previous posts about GCTT, but I'm not sure if they are still relevant as some are a few years old now. However, my daughter parked in an LDK group private parking area to go to the gym 3 x times. Each time she'd tried to enter the pin number for the gym but it was broken. She paid 2 x of the fines, but hasn't paid the 3rd one. She's a student living away from home and has not replied to the letters that have come through from LDK Group, she has then started to receive letters from GCTT and the fine has increased to £170. The latest letter is a notice of transfer to solicitors and have stated in the letter that LDK state that she has one last chance to pay LDK Group the £170 before the account is sent to their chosen firm of solicitors who are experts in the litigation arena for parking on private land and that the balance owed will increase as a result. What should she now do? She is insisting on ignoring the letter, but I'm a bit concerned.

Any guidance would be helpful at this stage. Thank you.

She has more sense then the person helping her it would appear.

She is correct to ignore it. At this stage it is just a speculative invoice (not a fine).

If she receives a Letter Before Claim, she can respond.

If she receives a Claim Form she must respond. She may never receive either. Full guidance is in the Newbies thread

The official MSE Guide which I helped to write last year (and it was personally checked & agreed by Martin Lewis) also says very clearly to IGNORE THE DRA LETTERS.

Tell her not to ignore a court claim and being a student with changing addresses, she MUST tell them and the DRA as soon as she moves. That's a CCJ risk if she doesn't (purely due to missing seeing important post) but otherwise, we can reassure you there is no risk in following our advice.

If she moves home a lot and you don't, it can be a good idea now, for her to respond and change her 'address for service' to yours, as long as you open letters for her promptly and you don't have anyone in the household who will panic and pay a scam, being sucked in by some red font!

If it does go to court, doubtful, the BUZZ words ARE …..

1: FRUSTRATION OF CONTRACT… simply because the machine was faulty

2: A FEEBLE ATTEMPT OF DOUBLE RECOVERY … the OSNER FAKE they have added
