GBP Management PCN Confusing NTK
I received a Notice to Keeper from GBP Management Limited dated 15 April 2026 for an alleged parking event on 16 March 2026.
A brief summary of what took place, the driver went to an establishment that allows its visitors to use the car park, but only from 6pm which the driver didn't know at the time, the establishment was therefore closed, the time of stopping and checking the establishment and returning to the vehicle took around 5 minutes.
The parking attendant sneakily came round to give the ticket during that time , no grace period was given whatsoever, when questioned by the driver, the parking attendant said that there was no grace period and it was too late because the PCN had already been processed. It seems that in the middle of the back and forth with the driver, the parking attendant forgot to serve the notice on the windscreen and/or give it to the driver, however their evidence pic shows the PCN ticket being held by the parking attendant but this was not served on the windscreen nor given to the driver
The PCN letter received in the post states I can no longer appeal because the time has elapsed, but the notice also refers to appeals and POPLA. Can anyone advise whether the delayed keeper notice and service of the PCN give me grounds to challenge this?

Anyone can appeal. The opportunity to appeal has not expired. ZZPS are lying to you (but don't appeal as driver).
You had 28 days from 15th April to appeal and that means you have 2 days to appeal as keeper.
Not that it matters because you'll never pay it!
I'd like to see POPLA faced with an appeal from the keeper, based on the fact that the NTK has unlawfully added an imaginary fee of £27 on the front and a further 'fee' of £1.95 on the back
That breaches POFA 'maximum sum' and the rule that says a NTK issued after a Notice to Driver must 'repeat the information on the NTD' including the parking charge which wasn't £127 (nor £128.95) and cannot be raised at this stage, not even under the 'bent' Joint Code of Practice.
Appeal on that basis alone. Except… in the back of my mind… doesn't the Joint Code say that the right to appeal must be available for 28 days from 'service' of the NTK, not the date of the NTK? Check it. If yes, add that too.
DO NOT MENTION THAT THE DRIVER SAID THE PCN WAS NEVER SERVED.
And don't say who was driving and don't take any crap from ZZPS in reply!

No, it s not that specific. It's just 28 days "of" the notice. Wherever that means.
But that random add-on charge is plain fraud.

Thank you
Well I believe their argument is that the right to appeal is expired since it was originally on the original ticket and the letter came after the appeal window

Yes but the right to appeal doesn't expire like that. They are lying. But you'll be appealing as keeper anyway (tell them to do one, when ZZPS reply and try to insist you should tell them who was driving). ZZPS are nasty.

Having sent the appeal, this is their response
"Having reviewed your correspondence, please note that this Parking Charge was originally issued as a notice affixed to the vehicle at the time of the contravention. The notice clearly advised that any appeal must be submitted within 28 days of the date of issue.
As your appeal has been received outside of this period, we are unable to consider the grounds raised in your correspondence.
For completeness, we do not agree with your assertions regarding compliance with Schedule 4 of the Protection of Freedoms Act 2012. We are satisfied that the Notice to Keeper issued in this matter is compliant with the requirements of Schedule 4 and that keeper liability has been established where applicable.
As the appeal period has expired, you now have two options. You may either arrange payment of the outstanding Parking Charge or provide the full name and current serviceable postal address of the driver at the time of the contravention. Should you wish to transfer liability, these details must be provided within 7 days of the date of this email.
We will not be providing any further documentation, evidence, contractual information, or additional correspondence in relation to the points raised."
Any thoughts?

LOL. So they won't accept your appeal, but they've given a response to your appeal 🤣

This is the exact wording you would have received if you'd been in time to participate in the farce of their phoney "appeals" process!
All that is happened is that you can't go and appeal to POPLA. Which is no big deal.
Now you simply ignore and come back for reassurance if you receive a Letter Before Claim. Ignore the debt collection toilet paper that comes before.3 -
Needs a complaint to the BPA AOS team about ZZPS and GBP Management.
ZZPS have now rudely refused to engage further, saying…
"
We will not be providing any further documentation, evidence, contractual information, or additional correspondence in relation to the points raised"…so that complaint avenue has clearly been exhausted, hence now complaining to the BPA!
The complaint is threefold:
- the NTK has unlawfully (and in breach of the Joint Code) added an imaginary fee of £27 on the front and a further 'fee' of £1.95 on the back. That breaches POFA 'maximum sum' and the rule that says a NTK issued after a Notice to Driver must 'repeat the information on the NTD' including the parking charge which wasn't £127 (nor £128.95) and cannot have a scam 'fee' added at this stage, not even under the Joint Code of Practice which caps the charges on a NTK at £100. This is not at DRA stage, this is ZZPS as a third party mishandling appeals for small PPCs and they only get a cut if people pay;
- The Joint Code also says that the right to appeal must be available for 28 days from '
service' of the NTK, not thedateof the windscreen NTD. - ZZPS have refused the keeper's right to appeal, lied about the POFA maximum sum, lied about the timeline to transfer liability (which is allowed in POFA Sch4 at any time before court action commences) and refused to issue a POPLA Code. The keeper's right to appeal seems to have never existed according to ZZPS.
They are appalling.
Utter rogues IMHO and the person who runs it - Gary Osner (who is also on the BPA Board pulling their strings) - had his last DRA firm (Roxburghe UK) banned from renewing their credit licence by the Office of Fair Trading, reportedly for unfair and misleading consumer correspondence and debt collection practices very much like this case.
The OFT "uncovered malpractice, such as issuing letters that misrepresented debtors' legal standing and neglecting to properly investigate disputed accounts."
Whilst the FCA later came to an agreement with the companies:
"…the outcomes did NOT include any acceptance by the FCA "that the Appellants are fit and proper persons.
None of the Appellants are now FCA authorised to conduct any regulated activity. […] On any future application, the issue of fitness and propriety would need to be determined. This outcome does not prevent reference being made to the underlying facts which were gathered in the course of the OFT investigation should any party apply to the FCA for authorisation in the future."
Not a good look that (it seems, allegedly) you are still treating consumers unfairly, Gary Osner/ZZPS
I'll refer this to the BPA (and I'll copy in the MHCLG) for you, if you want. Send me a pm if you agree, authorising me to raise it with the BPA and MHCLG.

Oh dear….
"The period of parking that immediately proceeded the issue of the notice to driver"
So (scientists hat on!) a period of parking of nanoseconds- Plenty of time for consideration of contract then!
Do PPC's get anywhere legally with poop like that?
Another mini outfit trying their luck and not knowing their POFA from their sweet derriere.
Nincompoops!

I think now it's best if you make the BPA complaint and I'll show the MHCLG and also the CMA.
ZZOS need stopping.
