Mobile phone replacement difficulty

Complained to ee several times in high street shop about samsung phone that makes my voice sound robotic and eventually cuts out completely. All my friends told me about this problem receiving calls from me,also I have problems connecting to the Internet. After many updates and fiddling with the sim card by the shop they finally agreed to send it back to be looked at. Unfortunately they have just informed me they can't find anything wrong with phone and have just done another update and will send it back to me. This phone hasn't worked properly since first having it at the end of last summer and my old phone has worked fine while it was in for repair which suggests to me it must be the new phone is the issue, don't feel I should have to use old phone to solve the problem..any thoughts?

Unfortunately, consumer rights legislation places the burden of proof on the consumer to be able to demonstrate a fault (and that it must have been present at the time of sale, even if latent) once six months have passed, so if EE are unable to find a fault then it's likely to be necessary to pay someone independent to do so, which you can then take up with EE again…

Could you go into the shop and ask if you can call them and when they pick up show them that your voice sounds robotic?
