Smart Parking Claim - Not received DQ

Hello,


Last week I received a default judgement regarding a Smart Parking Claim on 27th April 2026. Now I have to pay around £340. (Claim form was sent in Nov 25).


I did acknowledge it at the time and sent my defence thanks to this amazing forum. However I never sent in the DQ. I forgot about this step as I would’ve completed it and sent it at the time of sending my defence.


The court claims they have sent a DQ to my address twice, however I am 100% I haven’t received anything.

It is definitely my bad for not checking the MCOL website or following up by calling the court… I relied too much on expecting to receive correspondence from them.


Is there anything to do at this point or should I just pay the sum to avoid destroying my credit score?

    As long as the CCJ is within 28 days, urgently ring and tell their solicitors that:

    • you'll raise a N244 application and will get the CCJ set aside but
    • as it's within the first month right now, you are prepared to settle without them being at risk of any costs at all
    • This has value to their client as it is another case paid.
    • reiterate whatever your defence was and say you know they always discontinue cases so this being settled will be a 'win-win' for both sides.
    • Speak confidently

    DO NOT BE MISLED OR BULLIED BY SOME DAFT PARALEGAL.

    DO NOT SAY WHAT HAPPENED TO THE DQ. SAY YOU DON'T KNOW WHAT WENT WRONG AT THE COURT END BUT WILL BE SETTING THE CCJ ASIDE AND SEEKING COSTS.

    DO NOT SAY YOU FORGOT THE DQ!

    Offer £35 to settle the case.

    Do not apologise for that offer.

    Say you know it covers the claim fee.

    Say you know they can end the matter now to avoid exposure to a Set Aside Application.

    Keep your offers in two figures;

    if they say £250

    you might laugh & say "£50 or I'll just do the application to set aside and you'll get nothing."

    Keep going with the conversation. Be completely confident & don't believe a damn word they say to scare you.

    Was refused today; but was quite later in the day;

    Little DCB Legal said they will not budge because the judgement was already made. kept saying that it's about compliance and not about my defence; I told them I don't understand why court messed it up; can definitely agree that I did not remember them what my defence was so…

    (I did not mention the missing DQ btw)

    Will try again tomorrow with a different agent and go in more depth with my defence.

    Ask for one of the solicitors. Do not speak to a paralegal.
