Hello again, I’m currently going through the process with DCB Legal on another thread. But have just received another PCN from CEL.

I have just complete AOS online, just wondering if anybody can advise on the particulars of the claim which I have attached with the redacted claim form?

My defence is, I managed to drive in to and park in the carpark without spotting any signage or meters, I’ve been back and taken pictures of the entrance and where I parked (admittedly there were signs, but not on the entrance to the carpark, neither visible from parking spots). I would have genuinely paid the couple of quid if I had knew. The car park was basically a dump of abandoned vehicles, no space markings etc..

I will attach a picture of the claim form and also pictures of the entrance and the route I drove to park, if anyone could advise on my best route and defence. Also are CEL likely to pull the plug before court?

Yes, CEL are generally discontinuing before hearings, since their established Head of Legal left last year. The new team doesn't seem keen on hearings for defended claims and are copying the DCB Legal MO.

Use the Chan and Akande defence para 3 linked in the Template Defence thread for CEL in-house claims.

Your first post above actually has a witness statement, a story, with pictures your version of events ( not your defence. )

As coupon mad stated, your defence against the POC is the template Chan and Akande defence, in announcements near the top of the forum

So follow the advice and deadlines given above ( not your WS. )

Out of interest with my evidence above does it look like I will have a good case if it comes to court? I’m not to up on contract law etc.. but surely there should be signs on the entrance to state?

Is there anything in the particulars of the claim I can use against them?

If it gets as far as a court hearing then the judge will look at the WS plus Exhibits and paperwork supplied by both sides and will make a decision based on all of it, so it would be foolish to predict the outcome of a hearing without knowing ALL the details, or the court location, or the Judge involved , or if they send an advocate
