PCN from UKCPM. Parking in residents Visitor Bay
I have read through the Newbies section regarding this subject, and now putting together an appeal.
I was visiting my 88 year old mother in a hire car, and she believed, according to her Lease, that I could park in the Visitor’s Bay as long as displaying her residents Parking Permit. She has an allocated bay, but she is unstable on her feet and the Visitor’s Bay is closer to her home. I subsequently received a PCN for not displaying the correct Permit!
The registered keeper (Hire Company) of the vehicle has sent me a copy of the PCN. Claiming “Parked in bay not matching permit”. I have since discovered when phoning UKCPM that a different permit should be applied for to use the Visitor Bays! The displayed signs are placed very high and not easy to read, with the smaller print impossible to read. There is no mention of what is required to park in the Visitor Bays. How is a visitor supposed to know what they must do?
On checking my mother’s Lease, it states that the Visitor Bay's can be used when visiting the owner/resident etc. There is nothing in the Lease that states there is a need to display a Permit. But at least by displaying the allocated Permit, it can be shown that the Lease is being adhered to.
The PCN has been addressed to the registered keeper (Hire company). They have agreed not to pay the PCN, giving me time to appeal. I wish to take away the responsibility from the registered keeper. On the appeal form, is it better to state I am the Driver, Hirer or Other. If I choose Hirer or Other, then is it more likely they will continue to pursue the registered keeper?
My mother, will also be contacting the Managing Agents of the land involved, in the hope they can have the PCN cancelled.

Look forward to any advice, and thank you in advance.

You need to get the hire company to transfer the liability to you, the hirer, by using the tear-off slip at the bottom of the NTK/PCN. Then you will receive a Notice to Hirer in your own name and can appeal that.

Looking at the PCN I think there will be instructions on the back page telling them how to transfer liability to you.

Thank you for your response. I assume this is on the reverse of the form which I haven't seen. Can I by-pass this step by just going ahead with the appeal process online?

No you can't.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Some good news. Before doing anything else, I started by complaining to the landowner (their managing agents). It took a second email to argue my case further. They contacted CPM and the PCN has been cancelled! 😄
