CitiPark/BaySentry PCN - Paid for wrong carpark
Hi there forum dwellers
I received a PCN through the post for a parking session at a CitiPark car park in April, just within the 14 day window. No windscreen notice.
The parking was paid for via the app, but the wrong carpark was selected in the app. There are two Citipark locations next door to each other and the wrong one was shown as 'closest' to me at the time (standing in the car park).
Citipark have confirmed via email that the session was paid for in the wrong location.
I have received the attached NTK but am unsure if the best route is to appeal based on the NTK wording, or based on a 'major keying error' as advise on the forum seems split.
Have added the NTK and removed vehicle details/my address etc.

As it failed to comply with Pofa2012, use a recent keeper appeal stating that you as keeper have no liability for the pcn due to the lack of Pofa2012 compliance and they should cancel the pcn forthwith ( and the driver will not be revealed. ) the presumed delivery date was Tuesday 28th April

Yep it's non-POFA in wording and dates.
No keeper liability is possible. Even if & when the keeper loses at the (industry-biased & owned) kangaroo court stage of IAS, they must NOT pay.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It was delivered on the 28th, assume that doesn't matter and it's the date on the PCN that matters?
And even then, it's the wording that's the thing to appeal on?

Correct, otherwise everybody would say that it came late, so the presumed delivered date of any letter is 2 business days later , unless the recipient can prove late delivery
It simply wasn't issued & posted quickly enough , regardless of the content ( failing dates and wording is a double whammy for them )
