vets4pets Bitterne
Hello there after some advice. Unfortunately I parked in a bay near to the Tesco Express in order to do some shopping. I returned to my car and then ate a sandwich before driving off. I parked for 38 minutes. Unfortunately this was vets4pets car park and I genuinely did not see any signage to say that I couldn't park there. I would like to appeal but also I got a bit nervous because I can see an old case where someone stayed for just 7 minutes at the same car parking area and lost their appeal. I have written an appeal do you think It is worth doing? Would you do anything else? I realise it will likely be rejected and I will have to do a POPLA appeal. Thanks in advance for any advice
Subject: Appeal – Parking Charge Notice
Dear Sir/Madam,
I am the registered keeper of the vehicle and I dispute this Parking Charge Notice. I deny any liability or contractual agreement.
There will be no admission as to the identity of the driver and no assumptions can be made.
The charge is invalid for the following reasons:
Inadequate and poorly positioned signage
The signage at this location is not sufficiently prominent to form any contract. There is no clear or obvious entrance signage, and the only visible sign is small, positioned low, and easily missed depending on the direction of approach. A driver entering from the direction used would not reasonably see or be able to read this signage before parking.
Unclear and misleading site layout
The parking area appears to be a shared forecourt serving multiple nearby premises, including businesses such as Subway. There is no clear demarcation, marking, or signage indicating that specific bays are restricted solely to Vets4Pets customers. A reasonable driver would assume parking was permitted for nearby premises.
No contract formed
Due to the inadequate signage and unclear layout, no contract could have been formed between the driver and your company.
Insufficient evidence of any breach
Your ANPR images merely show entry and exit times and do not demonstrate that the vehicle was parked in breach of any clearly communicated and understood terms.
Non-compliance with the Protection of Freedoms Act 2012
The Notice to Keeper does not fully comply with the strict requirements of Schedule 4 of the Protection of Freedoms Act 2012 and therefore no keeper liability can be established.
Given the above, I require that this charge is cancelled.
If you reject this appeal, please provide:
Photographic evidence of all signage in place on the material date, including entrance signage
A site plan showing the location of all signage
Evidence of your authority from the landowner to issue and enforce charges at this location
A POPLA verification code so that I may refer the matter to independent adjudication

Please edit your thread title because there's no such firm as 'Premier Parking' and that always confuses us.
You will lose the appeal so don't bother with POPLA stage either. Just ignore them after signalling your dispute.
See post 4 of the NEWBIES FAQS thread for the £170 threatograms to ignore … we don't want to know about those letters please! You'll know what happens after that, if they try a small claim (most cases don't) because you'll have seen that stage in post 2 of the NEWBIES thread.

Again not sure if it's relevant but I just wanted to highlight what the car park is like. I entered looking to my left and never saw the signage. I made an assumption that it was a shared car park as it didn't seem to be attached to the vets.

You redacted too much info on your NTK PCN letter and no back picture either
You should have left dates and times showing, but I would expect that they complied with POFA
I agree that it looks a confusing site or car park, which may be in your favour at court, not necessarily at POPLA
