Tesco Horizon parking charge

Hi

It’s been a few years but I am back again. It’s Tesco’s again but this time with Horizon. I see these things are called a Parking Charge these days, I received the charge via post 12 days from the alleged offence.

I verified at the machine when leaving the store but I have no proof.

Plan A - I have complained in store and been told there is nothing they can do. I have complained via email to the CEO but not had reply at this time.

Plan B – I will prep for submitting an appeal with the template 25 days from the issue date. Should I use the usual blue text template?

From looking at other posts, please can I ask: what makes the letter POPA compliant (or not)? I have been trying to understand why this is and I am struggling.

But the wording on the top back shows it's driver liability only! Non-POFA. Easy peasy!

The clue is the huge blank space at the top back which is normally much wordier, plus the words say 'driver' not keeper.

This is the appeal wording that I used for a Tesco Horizon non-POFA case last year. Obviously the keeper appeals and does NOT tick 'driver' but you know that!

You have sent a non-POFA NTK so you have no cause of action against me.

Under contract law there is no lawful presumption that the keeper was the driver. This was tested on appeal and the parking firm lost (VCS v Ian Edward).

I'm puzzled why Horizon send out both POFA and non-POFA letters. What would be the reason for this as I'm assuming a Tesco car park is always relevant land?

Dunno but they and Britannia seem to do this for no reason! Always worth checking.

Bizarre. I have one going through Popla from this month which is fully POFA and also from a Tesco (non-existent signage).

Every single PCN seen at Hove Tesco last Autumn - in the first weeks since Horizon took over from APCOA and changed all the terms without an extra entrance sign - was non-POFA.

Then they switched to POFA ones for later PCNs in the winter.

And I helped a friend shoot down over ten PCNs her husband had cluelessly accumulated from Britannia at Waitys, again all were non-POFA worded (even those that were easily posted in time). I was very surprised & happy to see it!

It's an odd situation at Horizon & Britannia. Looks random.

BTW a representative of Tesco CEO got in touch saying "….unable to provide assistance….follow the appeals process outlined on the letter….".
