Travis Street Manchester
I intervened for a friend who received an unfair ticket for staying at Travis Street car park where they spent 20 mins trying to pay using the app (the only way to pay) and then left after being unsuccessful. Somehow I am now being taken to court by Car Park Securities as keeper despite never being the owner or keeper of the vehicle. I completed a form to DVLA to provide evidence that i was not the keeper, sent a £5 fee, and they havn't bothered to respond. Disappointed to see DVLA not supporting a motorist over a parking company!!

If you actually have a Claim Form you MUST defend properly using MCOL. Do you have a Claim Form? Show us.

I am defending, court date came today for June. I was not the keeper or driver and the parking event was in the morning not 7.36 to 8.13pm as stated in claim form, so its all a bit of a shambles

I also attended a mediation session where i said i wasnt liable for the PCN as not the keeper, the mediator relayed this to the operator and they responded by 'see you in court'

OK so you have already defended!Interesting to see an in-house claim by CPS. Show us your defence, verbatim.
And are you up to speed with WS & evidence stage, as explained in post 2 of the NEWBIES thread? However, your case is different because you cannot be held liable.

What exactly did you ask the DVLA for? I'm not aware of any £5 fee.

You or someone must have given your name and address to them that's why they are pinning this on you, otherwise how have the scamming idiots got your details?
The DVLA require you to fill out a V888 form with a £5 fee as a request by an individual for the information about the vehicle as you are not the keeper, they should have responded.
Looks to me like trying to help your friend you have confused the issue and the PPC have made the wrong assumption that you are the keeper and they never actually made a keeper request to the DVLA.
Surely it is up to them to prove you are the keeper (with evidence) as that is on the POC they have unusually not included the driver in the claim I don't see how they can win on that point. But others will have a more experienced view.

Yes i completed and posted a V888, you can't do it online and have to pay by postal order. I have a letter from CPS naming the actual keeper so they did get their details but must have just confused the names at some point. Also the signage they are relying on is a bit dodgy to say the least, no mention of parking charge cost or where to find t & c's
