Parkmaven / DCB Legal - Court Claim - Holiday Inn - BMW Hire Car

IMPORTANT: I am already at court claim stage and have filed my Acknowledgment of Service. I need help with my defence — deadline 21st May 2026. I am NOT at the PCN appeal stage.

Hi all, I have read the Newbies thread and have acknowledged service online via MCOL. I would really appreciate help putting together my defence.

The basics:

  • Claim form N1SDT received 24th April 2026, dated 21st April 2026
  • Claimant: Parkmaven Limited (via DCB Legal)
  • Location: Holiday Inn Express car park
  • Allegation: ANPR — entered and exited without registering vehicle
  • Acknowledgment of Service filed — intending to defend all of the claim
  • Defence deadline: 21st May 2026

Key facts:

  1. The vehicle was a hire car from BMW — I am not the registered keeper
  2. I received absolutely no correspondence before this court claim. I use an address forwarding service and have only ever received this single claim letter. My driving licence is still registered to my previous address. Despite this, no prior notices, Notice to Keeper or Notice to Hirer were forwarded to me at any address — this is the first and only correspondence I have received
  3. I was a paying customer of the Holiday Inn Express bar on the night in question — 29th September 2025 — and have a timestamped receipt proving this
  4. I was there with work colleagues who can provide witness statements confirming the date, time and that we were together
  5. It was dark and raining on the night in question
  6. I have no recollection of seeing any signage on the night. Having since reviewed the location I am aware of two signs — a blue "Car Park Tariff" sign with a completely blank tariff section containing no terms, no penalty amount and no mention of any requirement to register a vehicle, and a green "Public and hotel guest parking" sign which is unlit and positioned against a green tree background, making it virtually invisible at night in the rain. The green sign simply directs drivers to signs inside the car park which themselves contain no enforceable terms
  7. There was no machine, app, or any instruction anywhere on site to register a vehicle
  8. I went directly into the hotel bar upon arrival as evidenced by my receipt, meaning I had no opportunity to see or comply with any terms even if they had been visible
  9. The car park sign identifies the operator as "Your Parking Space" — I am unsure of the relationship between this and Parkmaven Limited
  10. I will be visiting the car park tonight to photograph all signage in similar lighting conditions to the night in question and will add these photos to this thread

My questions:

  1. Given it was a BMW hire car and I received no correspondence whatsoever before the court claim, have Parkmaven correctly followed the POFA 2012 Schedule 4 Notice to Keeper / Notice to Hirer process? Can they legally claim against me personally?
  2. Does the blank tariff sign fundamentally undermine their ability to prove a contract was formed?
  3. Does being a paying bar customer (evidenced by receipt and witnesses) strengthen my position as a legitimate authorised user of the car park?
  4. Which template defence should I be using for a DCB Legal / Parkmaven claim?
  5. Should my defence focus primarily on the POFA procedural failure or the signage/contract argument — or both?

I will post photos of all signs tonight and can post the Particulars of Claim once redacted.
