Thuis may sound Churlish what is the defintion of the Supervisor role compared to oridnary staff memebers and to managerial grades
a well know Quick Service Restaurant chain has a number of Hourly paid roles
'Crew Member' many franchises and company locations pay a few pence over the NLW (21 +) for crew members 18 + and well in excess of the relvant NMW rate for 16 -17 year olds
'Crew Trainers' who mainly are responsbile for teaching and assessing crew , mainitaing standards , but can also do delegated Management tasks and complete Task books and Assessments to be an Area Leader , where their role becomes closer to that of the next grade up but doesn;t necessarily change pay rate - this is current +40p hour on base rate compared to adult Crew ( 17 year olds can be appointed as a CT and get the adult rate)
'Floor Managers' Run areas , take charge for parts of the shift , can do refunds /discounts , sign peopel on and off tills , +40p/hr over CT / +80p /hr
'Shift Managers' take full responsibility for the restaurant Shift to Shift therefore must 18 + ,+40p/hr over Floor manager / £1.20/hr over adult Crew , enhanced night enhancement as will be the senior in the building at all times on a night as Salaried Managers rarely work nights unless it's an Emergency
the fairness or otherwise of the Supervisor role having a small differential over ordinary staff will depend where on that kind of scale the role sits0 -
I was under the impression that they only need to pay the employee NMW & so long as they're meeting this requirement then they're doing nothing 'wrong' (legally)?
Am I incorrect in my thinking? Be interested to know.
Now I'm not getting in to what's fair vs what's illegal. I've suffered the wrong end of that stick numerous times & currently still am.

You are correct.

Thanks for the clear up.

In her position, I would try arguing the case that it's been customary for an hourly rate differential of X% between floor workers and their supervisor grade and try and build a case to reinstate that differential (at a local level).
Is she a union member?

Are you not really applying to their kindness in that situation though rather than a right/wrong & a company as large as B&M are surely not going to give a damn about the little person?
I've worked for my company for over 20 years. Overtime has always been paid at a rate of 1.25x. Since this latest MW change my new overtime rate is less than 1.25x for the first time ever.
But it's a case of - "don't like it, quit" & "you should think yourself lucky you have a job".

Pretty much the norm in the retail / service sector. There will be hundreds queuing up for your job when you quit, staff churn is the norm and you can easily be replaced. Been there done that on both sides of the desk.
