BW legal / Napier parking

Hi all,


Stayed in a Napier car park in August, paid right away for an hour. Had a medical emergency on the beach, first aid for my little boy’s bleeding foot (hottest day of the year too, phew!)


Got back to car in time, waited for AC to kick in, left car park.

We overstayed parking by 13 minutes, which is reduced to 3 minutes when the legal grace period is considered.

We appealed because it was three minutes and our autistic son had a medical emergency, and since I am also disabled, it slowed us down and meant we miscalculated by a few minutes. I repeat that we paid for parking, but outstayed the timeframe by a few minutes.

They rejected our appeal but did not inform us, no letter. Next we heard, BW legal. Having not received the appeal rejection over christmas meant we missed deadline for IAS etc but i contacted them anyway so have a good paper trail.

Bw legal then sent the final claim form to an address we lived at four years ago and I only have a few days to respond, i offered to pay £5 for the extra time in addition to the parking cost we paid but they rejected this.

Today received the court claim form and I need help in working out next steps. All advice welcome.
