I'm having a similar issue except my travel company are claiming the tax was never a real cost and wasn't charged to me and that my insurance should not of deducted it from my claim. Here’s the thing, insurance company's are supposed to refund loses which you can't get elsewhere, my travel agent is claiming it wasn't charged to the airline or given to the airline as the tickets were never issued as I cancelled due to illness. This is waffle as it doesn't matter if the airline tickets were issued or not because it's said that, that tax would of been charged to the customer on the initial booking. so how to prove it, which I’m now going through is doing me head in. because i'm being bounced between both travel agent and insurance company.
I think i'm going to end up writing to the ombudsman to intervene here, your right it doesn't seem fair that they keep the tax, as it’s a tax, not the payment for the item or holiday sale. Imagine all people who cancel, how much money they keep form taxes. when they refund in full or part of your holiday you wold get back the 20% vat you paid and also any claim with the insurance company would mean you get back everything including the vat, apd is just another tax.
I will be mentioning this to my local MP, they are the people representing our internet and complaints to do with stuff like this, you pay for them to listen to you, i shall be writing to my local mp o this issue, after what i'm going through, as the tax doesn't belong to the airline unless you fly, but also it does not belong tot he travel agent, as it's a tax. IF there is any truth in what they say about the cost was never charged and NOT real cost, then where did my insurance company get the info that I was charged this tax? And where did the travel agents legal department get the info that the apd wasn't applied to my booking. all I have is a summary of the full amount paid, I have no breakdown of taxes.
I enclose screen shot of my travel agents response, I have read through so much information on this, but i can't see anybody being told this information the same as I have. I have posted about it here on this forum.
