Gladstones Letter Received informing of CCJ Judgement - no court letters received

Hello,

I have received a letter from Gladstones stating I have received a CCJ Judgement at the start of the month, also alterted via Clearscore. I moved last year and sold the vehicle, after moving but never up-dated the address. We have mail redirection set up so have been receiving letters directly from Gladstones plus parking operator, just no letter(s) from the court itself. I have an existing MCOL account from a previous parking CCJ, but nothing appear on there either. Do I stand any chance of getting this set aside via the N244 route? Or should I just pay the £270 due and be done with it?

My concern is that if I go via the N244 route and this is rejected the CCJ remains on my credit file regardless vs paying the £270 is safer in this respect, or am I misunderstanding the N244 process?

Contact the CNBC in Northampton for more details, especially the name and address where the claim form was sent to, plus the POC details and claimant name

The onus is on them to do a final trace precisely for situations such as yours. It costs them 10p! Some of these cases are up to 6 years old, so keepers move.

    See Carr v VCS.

Ultimately you'd be best going for a set aside and they should be liable for costs.

In theory yes but if Gladys used an old address, then the court cannot reject your application and the CCJ set aside is mandatory. With your costs awarded back against them in almost every case.

Do the N244 with Draft Order and WS.
