CPM-no parking on access road fine

Hi

I have received a letter through the post stating that i had blocked access road. But I was on a road that was a dead end and from the image you can see there is a car parked behind me.

I needed help to see what I can say to fight my case as this is not private land and it is a road with yellow lines and the name of the road is not mentioned on the letter. The signage is so small and in the dark you can not see ther t and c's. Moreso the image was taken by an individual on patrol not a professional parking attendend.

I went during the day and I found the sign which i have attached to this message. I also looked at google earth to show in red where there are road bollards blocked off for the rest of the road and highlighted in blue is where I have parked.

    You have not received a fine.

    The registered keeper of the vehicle ( you) has received a "parking charge notice" for something that the driver of the vehicle on that day did, or didnt do

    The Registered keeper ( ie you) can be a separate entity to the Driver on that day/at that time and agin the owner can also be another entity.

    Only if the parking company has fully complied with all parts of the protection of freedoms act can they hold the registered keeper liable, unless you tell them who it was either on here, or in some half arsed panic driven "appeal"

    As for the signs, they appear to be prohibitive and unable to form a contract as the driver can not agree to do something they are not permitted to do (No parking)

    Dear Sir/Madam,

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    There will be no admissions as to who was driving, and no assumptions can be drawn. Since your PCN is a vague template, I require a full explanation of the allegation and your evidence. You must include a close-up actual photograph of the sign you contend was at the location on the material date, as well as your images of the vehicle.

    Furthermore, I am challenging this speculative invoice on the following grounds, and require strict proof of your claims:

    1. Location Mismatch and Lack of Jurisdiction
      Your PCN states the vehicle was parked at "Saxon Square, Luton (Patrol)". However, the location where the vehicle was actually parked is on Stirling Drive. Your provided photographic evidence only shows the vehicle in isolation and fails to establish that it was parked within the boundaries of your controlled land.

    I require you to provide a detailed site map and the corresponding Land Registry title plan to definitively prove that the exact spot where the vehicle was parked falls under your jurisdiction and client's ownership.

    1. Lack of Clear Demarcation
      The area in question is not clearly demarcated as private land. There are no boundary markers, entrance lines, or clear signage at the specific location to suggest to a motorist where public highway ends and private land begins. You cannot reasonably expect a driver to be bound by terms and conditions for a parcel of land that is not distinctly identifiable as private property.
    2. No Obstruction Occurred
      Your notice alleges "No Parking On Access Roads / Roadways". The vehicle was parked entirely out of the way of any thoroughfare and was not blocking or obstructing any access points, vehicles, or pedestrians. I request a clear site layout showing the specific access road you allege was blocked, along with photographic evidence demonstrating an actual obstruction taking place.

    Conclusion
    The burden of proof rests entirely with UK CPM to demonstrate that the driver entered into a valid contract and breached its terms on land you actively control. Your current evidence fails to do so.

    Therefore, I demand that you cancel this unfair Parking Charge Notice immediately. If you choose to reject this appeal, you must provide a detailed response to each of the points raised above, along with the requested evidence (site layout, Land Registry plan, and specific boundary photos) and my unique IAS (Independent Appeals Service) code so that I may escalate this matter.

    Wasting your time they won't cancel and the IAS will just side with them, the signage is totally deficient no entrance signs at all just one small sign on the right that blends in, anyone would drive in and think it was an adopted road. A blatant honey trap and scammers paradise!

    You will have to sit this out for the duration I think and follow the advice on here.
