Euro Car Parks Parking Penalty at Esso Garage

Hi, I've received this notice todayin the post as the car registered keeper from Euro Car Parks issuing a parking Charge Notice.

I've spoken to the individual who was using my car at the time to vacuum my car and refill the air.

The notice on the parking charge states that the time taken to enter and leave was 56 minutes. From my understanding having spoken to the person, they first parked the car in the spaces outside the store/ payment area to go inside ask about using the vaccuum /tyre pump and that they had to wait in a queue for a while possibly around 5 minutes. After chatting to the attendant, my friend moved the car to the area where they could get the car vaccuumed and tyres pumped. At no point did the store attendant advise that there was a time limit or that there could be a fine imposed.

The friend vacuumed the car (payment by my card) and decided to vacuum again for a 2nd time as the car wasn't quite cleaned enough. There was a person already in front using the air after this time, so there was another wait time. After the person in front had finished, my friend then used the air.

After this time, they left the forecourt.

I did ring the Esso garage to query this and to ask that I did have evidence of payment and they essentially fobbed me off as saying they couldnt do anything about this and that I had to go through Euro Parks.

Advice would be greatly appreciated - I have not had to deal with a private parking charge before and wanted to know how best to proceed. I believe the Esson garage is owned by MFG.

    As keeper, complain about it directly to MFG, with proof of payment or patronage, plan A in the newbies sticky thread in announcements near the top of the forum by coupon mad

    Check what the signs stipulate , because they bind the driver to the onsite contract between the driver and the private parking company, which may include registering the VRM inside the kiosk

    Check if the NTK PCN letter is compliant with POFA 2012 or not, advice is in the newbies sticky thread in announcements

    Or

    Name the driver and transfer liability from the keeper to the driver

    But

    Plan A is ALWAYS the best option

    Read the MFG examples in the Successful Complaints About PPCs thread. There's the usual fob off merchant to get past first.

    Thank you - I've had a look at some examples on the site and I've already spoken to Petrol station who has fobbed me off by saying they can't cancel the notice as they don't have that authority. I'll call MFG on Monday with other information.

    I'll also check if the NTK PCN letter is compliant with POFA 2012 or not as well as MFG examples in the Successful Complaints About PPCs thread.

    I'm hoping that as the driver was only using the facilities for the air and vacuuming that they will consider this as using services and not parking.
